EBAY LYING IN THEIR DEFENSE SUMMARY
Why would eBay lie saying that " I RECIEVED or will receive or will pick up " the item that I never havebrecievd. But not just lying but lying to my credit card company. Now my CC company has denied me for a 4 the time using ebays defense summary as the basis for their decisin. And it's not like it was $50 or $ 100 or hell even $300 item but only a mere $600. I know for a fact their lying cause when I sent the doc the the eBay person on phone they didn't know what to say and said that my CC company SHOULD HAVE refunded me. What's really stupid is that no one either eBay or my CC company acknowledges that the item was tracked by USPS where I got the info and the del address and the time the weight and the street name and date of when this letter (more than likely ) weighing only 5oz when the drone weighs 2lbs. So I ask myself what leads a dispute team to be so abhorrent and suck so much at their job.

If you haven't, do that right now.
CC company probably won't refund you if you haven't attempted to use eBay's process first.
File a "Return - Not as Described" or "never received" eBay claim (can do this under My eBay --> Purchase History). That's what gets buyers, who didn't get what they ordered, their refunds. Not CC disputes.

It's actually the opposite. It is eBay that will not deal with any buyer who has contacted their credit card company (or PayPal) about a refund. It's too late for the OP to file a claim.
[I haven't heard of any credit card company that insisted on eBay being contacted first.]

·2 years ago@house*of*paws I had a buyer make a CC claim and didn't do an eBay claim. It shows it was delivered, so I was able to keep proving it to the CC company. The CC company didn't grant them a refund (and they opened the case twice).
Had they just submitted an eBay claim of Not As Described or Not Received, they would've gotten fully refunded.
So, make eBay claim and only go to CC if it's denied, would be my advice.

Your advice to file a case with eBay first is totally correct … except it was too late for the OP to follow, since they stated that they’d already contacted their credit card company.
eBay will not help a buyer once they‘ve contacted another source.

OP2 years agoBut again I do not understand the cc for denying me for a 5th time and the last two times they denied they replied within 4 hours even though they said they would reach a decision until may.

OP2 years agoI did but then closed the claim voluntary the next day or like right after opening cause I wasn't sure what the process was and didn't want them to cancel the order cause at the time I still wanted the item and didn't want eBay to cancel everything by accident

If you filed a claim for "Item not Received" and there was tracking associated with the purchase that showed DELIVERED (of anything to somewhere) you will lose any eBay claim even though you received nothing. It is natural for a victim of this to file INR, when they don't receive the product, but is a guaranteed fail for any eBay claim.
If you file with your credit card, and insist on claiming "Item not received", they will send the query to eBay who responds with the same (albeit fake) delivery notice and you will lose again.
Since you obtained documentation that the parcel in question WAS NOT INTENDED for you, you need to give up on the "Item not received" mantra, and pursue your credit card claim under FRAUD/FAKE TRACKING SCAM.
Once you pursue redress with your card company eBay will no longer help you.

Since you do not make clear in either of your Posts/Topics, what steps you took, and when you took them, when you discovered the Delivered scan but did not receive the drone. It makes it very hard to help you.
All anyone who has read your rantings can figure out is, you were the victim of a fake tracking scam. Since it appears that you filed a claim with your card provider 4 times, we need to know if you did that before you filed a claim/dispute with ebay. If you did then you voided your ebay protections. If you contacted ebay by calling a phone number you looked up online, you never spoke to an actual ebay rep. The only way you can speak to one is to request a call back.
Since you are now stuck with only being able to deal with your card provider, if you read what I posted in the link below, you will find out what you need to do in order for them to give you a refund. There is also information in it that explains why ebay and your card provider can't get the information from the USPS or other shipping companies.

Let me start by saying that I THANK YOU I THANK YOU FROM THE BOTTOM OF MY SOUL... to the top fringes of my hair. You sir are what is needed in every forum that exist in todays world. You are the definition help. Without this knowledge i was gonna go crazy on why noone seemed to grasp what i was saying, but now my small minded body knows why. Its a beautiful thing to wake up and read your reply, because i went to bed with just reading another email from the cc co. stating their denial once again. I definately know what i am gonna be doing right now based on your words. I never knew this scam existed, i kinda figured Ebay was without risks associated with these types of things for i never had a problem in 7 years until now. So in actuality noone was lying but just bound to company policy per say. So how come these types of problems with positive resolves arent more openly discussed ? I didnt even know this forum existed and just by chance ran across it and was posting to anyone. It just doesnt seem like this is as big a deal or known about until it happens people themselves like me. But regardless i see this as definately 100 steps in the correct direction with light at the end of the tunnel. But over a quick glance im sure i will have a question or 2 in order to not foul what i see as my only and last chance to be whole again. OP2 years agoOk so i just wanna make sure that i dont blow this chance so should i state the entire situation so that i can ensure that all you said will pertain to it? ill make paragraphs like someone suggested..ok and ill only state my actions on when i did what i did and t whome i addressed.
so after not recieving the item for like a month i did open a claim with ebay but then closed it voluntarily cause wasnt sure that it was the correct thing to dothen ebay nds up stating i need to handle it with my cc co. so i open a claim with them but then found out it would take like 2 months with them so i went back to ebay and told them i didnot wanna wait that long which they said ok the workaround is to cancel it with them and ebay will regain authority so i did and after 2 months i was told it will never be reopened with ebay so i reopen it with cc co. and been denied ever since. and i only spoke with phoned people from ebay using the call me back feature. so i hoping this fits your instructions . and multiple emails and the amount of argueing with them and numerous calls this is where im at now.

OP2 years agook heres the 1st question so now that i must go thru my cc co. do i submit the note written by the clerk to them or ebay first or just my cc co . because they go to ebay and if ebay has that info then they should just convey that info to my cc co . correct? or do i leave ebay out of it and just deal with my cc co.? and i am dealing with just my cc co. i dont deal with the instagram and facebook stuff right? and you know i have been teling them to check with the USPS also and that i recieved the alternate address from the usps verbally over the phone from where they gave me the street name time and weight . but i think they didnt even do that

The first time you went to your c.card company, your option to get from eBay is removed. As a matter of fact, once you closed your initial claim with eBay, you cannot open another for the same reason.
You are going to have to deal with your card company again, hopefully with the new evidence you obtained and NOT filing "item not received", but rather Fraud/Fake tracking scam. Call them.

OP2 years agoOMG , OH WOW..Well just xame back from post office armed to the hilt with documentation. So went and spoke with this guy and gave hime a copy of the order details that has the tracking number on it, and explaine that i needed him to verify the tracking number with the shipping address. So he comes back and says yeah it didnt go that shipping address and how i spoke with a USPS person the phone and they verbally gave me all the info but i need documentation besides a email AND HE WOULDNT DO IT...and i asked if he would be willing to go to a higher up for approval to do it and says im the one thats gonna say yes or no..and says i should go to the anaheim post office but then later he said that noone would do it.Ya know this is insane totally insane. i say lets pretend that that was my address and i wanted proof of delivery he said that the copy i printed is proof ..what a idiot. Well im just bout out of umph for this, wanna talk about falling thru the cracks in the process. So i am basicaly gonna take this one in my prison pocket it seems.

I suspect the OP pursued the claim under INR, when it fact it was a case of Fraud involving the fake tracking scam problem. eBay responds to the credit card claim with the same phony "tracking shows delivered" and voila!!!!
