EBAY Guarantee is completely useless and USPS is incompetent. Can no longer use Ebay.
USPS mishandled my package and sent it to the wrong address. EBay says it's not their responsibility and I have no insurance information from the seller for the package. So, I'm out $312 and there's no way to get my money back. Will no longer use Ebay. They are the worst and don't care if buyers or sellers are out money for something that is out of our control.

Yes, there is. You can read some of these for buyers that are in the same predicament as you. First step, is to GO to the Post Office, bring a copy of your transaction with the tracking number related to the sale. Speak to the person in charge, and find out if it was mis-delivered OR not intended for you in the first place. A package of paper clips sent to the local gas station or KFC restaurant will suffice to trick the eBay bot, and eBay CS that you get in a call back or chat have no authority to override a bot decision anymore.
USPS used to be pretty reluctant to help a victim of this, but they do now assist with such FRAUD. They may even give you a copy of the label to use in your defense.

How do you know it went to wrong address? Did you contact the seller?
Does tracking show it is delivered?

First, if tracking shows delivered USPS insurance wouldn't cover it anyway. You need to contact USPS and ask them to check the GPS data on the delivery scan. That will show exactly where the package was delivered. If it wasn't delivered to your address you need to ask USPS if it was addressed to your address. If it was and USPS just misdelivered it, that's also out of the control of the seller and eBay. USPS is solely responsible.
But if the package was addressed to an address other than yours you're likely a victim of the fake tracking number scam. If that's the case, come back and let us know. We can tell you the information you need to appeal eBay's decision.

·2 years agoWith a typical Ebay MBG request insurance can be bypassed (for the buyer) but if USPS is at fault with no insurance added, what amount if any would USPS be liable for? (financially) Sounds like Ebay (seller) have bowed out of any financial responsibility which leaves USPS the one to determine the payout for the loss.
How would this play out if USPS determined if they Did ship to the wrong address but there was no insurance added to the shipment? (if they can not find it or re deliver it because it is now lost)

·2 years agoEBay's premise is that since buyers are covered by the MBG, insurance is solely for the benefit of the seller. If a package is damaged or lost (never shown delivered) the MBG pays the buyer and the seller goes after USPS for insurance reimbursement, if they purchased insurance.
But here's the wrinkle. Once tracking shows delivered USPS is going to deny a lost package insurance claim, because the package was delivered. It doesn't matter that they didn't deliver it correctly. It's part of the great black hole of USPS, the same one that also refuses to reimburse postage if they lose your package. Because hey, they handled it right up until the point they lost it.
I personally have never heard of a case where USPS paid off on a misdelivered package. So I think the question is not how much they'll pay but if they'll pay. But I'm absolutely certain that it's wrong to blame eBay or the seller for USPS's screwups.

·2 years agoI knew USPS was difficult to win cases (although i have won a few but lost more) it really is disappointing that if they do acknowledge they screwed up, that they would not pay for the item. (or value) Of course USPS would be to blame but the fact they would not pay out the case with insurance does seem like fraud. Fed Ex has a similar issue with there insurance where anything over $1500 they will not cover if damaged. However they will charge you for $20k of insurance (if that was the value of the item shipped) and only pay out $1500 (The payout is roughly about $1500-$2k, its been a few years) I stopped using them to ship vintage guitars because of that. It is amazing that these companies can get away with it and maybe it takes a class action lawsuit for it to change.

OP2 years agoI submitted a investigation request and the local post office that delivers my mail admitted that they delivered the package to the wrong address and that it's irretrievable. Absolutely ridiculous. Their employee admits fault and they still will not pay out.
