I left feedback on Ebay in regards to a seller that sells alot of Jewelery on Ebay not representing the item right and refusing to refund my money. Ebay deleted my negative review, why is that? I am so far out over $3000

·2 weeks agoAs for why your feedback was removed, that happens automatically when a seller uses their 50% refund withholding Seller Protection. You were also automatically reported to eBay for abusive buyer behavior. And the seller won't get an Item Not As Described demerit on their Service Metrics, because this wasn't their fault. You abused the Money Back Guarantee by returning a damaged item.

OP2 weeks agoIf i understand correctly you support business selling fake items on eBay and having no accountability? I have asked for an independent assessment of damage and they are refusing if it, it sounds like you support that?

·2 weeks agoYou are saying two different things: (1) Rolex told you it's a fake and (2) You are almost certain it was a fake. Which is the truth?
Plus you admittedly returned it after having it sized and scratched in the process?
If you want help, you need to present accurate facts that make sense. Sellers get scammed by buyers all the time here, so we are trying to determine what actually happened in your case.

OP2 weeks agoRolex told us it was was fake, where it gets confusing is was it a total fake or what was it? I don’t know as I did not get it evaluated any further as wanted to return within my 30 days. What I am asking now that they have it back is that I send it to a 3rd party to assess, I was unaware of scratches but they are on clasp. Scratches on a fake Rolex clasp are obviously less of a big deal than on a real clasp. Either way a few scratches from normal wear on a clasp is not $3000+

Sounds like you sold a watch that did not go through authentication, is that right?
If so, you should have been offered authentication services for an additional $80. The watch would have been inspected and transaction canceled if it didn't pass. Keep that in mind for next time.

I think I know which seller you purchased from and that seller has a 30-day free return policy.
But the feedback you received from the seller is over 30 days old. Is that why you didn't get the refund?
What do you mean by "I cannot get the band back?" Where is the band? Did you return it?

OP2 weeks agoI returned band watch and everything within the 30 day policy. When the got band back there was a couple minor scratches on the clasp and a link missing as we got watch sized and it was worn. If it was a genuine Rolex band the fix/polish would have maybe been $300. I am 95% certain the band was not real so worth about $5-$30. I bought watch under thought of if I found out it wasn’t real or up to standards I could return it. The seller obviously has this strategy down to a system with returns, blow up the actual cost of any minor scratches and charge buyer and extreme amount for a repair that in actuality cost $100 or less with labour. The seller is not willing to confirm that the band is indeed a genuine real Rolex band but as soon as I put anything on eBay in regards to feedback I got from Rolex my comments got deleted, with no response on what I said that was untrue or not allowed. Seller has nothing to lose to continue these selling practices

OP2 weeks agoI am asking to send it off to prove it is real but they are currently not wanting to do that. What would you do if you bought a watch you thought was real then found out within your return period that it was likely fake? Pay $3000 for repairs on a fake $20 band or question authenticity?

The listing I suspected it was is for a watch BAND but you just referred to a WATCH.
if you bought a $3000 Rolex, it would have gone through the "authenticity guaranteed" program and if they found it to be authentic, then your "belief" that it's fake is likely incorrect.
Ebay uses real jewelers for their AG watch program.

OP2 weeks agoIt was the whole watch I bought, but the holdback on refund for $3000 was for a band and clasp. I should have used eBay authentication program for jewelry but was not aware that was an option at the time. I have asked seller to send it there since to simplify claim process and they are refusing to. I have no problem paying to get it evaluated but getting hit $3000 for damages on what all indicators say is a fake watch and band is extremely excessive

·2 weeks agoNope, you've got it wrong.
If a seller lists an item that is part of the authenticity guarantee program (brand/price/), there's no ability for a seller to opt in or to opt out.
And if a seller somehow circumvents the authentication by using an inappropriate category or other item specific, they can find themselves sanctioned by ebay.
As the buyer, YOU have no ability to choose whether an item will go to the authenticator.

·2 weeks agoYou bought, used, altered and then returned the item claiming it was fake on absolutely nothing but a sudden belief just before the 30 day return period was up. The seller has ABSOLUTELY NO reason to do anything for you but issue the refund you have already received. If they're smart they have already blocked and reported you and moved on from this mess.

·2 weeks agoThere's something really off here. Watches over $2000 automatically go through eBay authentication. It's not an option, it's a requirement. And when you go through an official return of an authenticated item (assuming the seller accepts returns) the return goes back to the authenticators first to verify it's the same item. But you say it went directly back to the seller.
The real issue here is that you sent back an item you only suspect of being fake, that was altered and damaged by you prior to returning, apparently without going through the official return process. And according to eBay's Money Back Guarantee there's an exclusion when "The buyer returned the item used or damaged".

Without knowing more details and exactly what you said, I can't give you anymore feedback than that.
I gut tells me there is more to this story, so let me ask did you open a return? Did you return the jewelry you say was misrepresentaed?

OP2 weeks agoYes jewelry was returned they want to keep over $3000 because there was a scratch on the clasp and a link missing. I am almost certain the watch band was not a real Rolex but I cannot get the band back to get it appraised. Now I need to stess for 3 days to see if eBay will consider taking buyers side vs seller that has 100’s of listings with them. Hopefully I get a fair shake

·2 weeks ago · Edited@jprtyahoo Some sellers are able to reduce refunds by up to 50%. That is what sounds like is going on. If that is correct, you have a right to appeal that which it sounds like you have done. How eBay will rule, I cannot say. I can say I've never had eBay rule against me when I've reduced a refund. I've never withheld $3,000 though. The most I've withheld is $400. I had strong evidence to support why I did that. eBay denied the buyer's appeal. They then opened a chargeback. eBay fought that on my behalf.
When you say that the seller did not properly represent the item, are you alleging they sold you a fake watch and did you state that in the feedback?

OP2 weeks agoYes Rolex told me it was a fake. So I used my 30 days to return. All I am looking for is a fair deal and to warn others. Totally eroding my trust in eBay, hadn’t used it in a while and was just starting to use it again. Wish I didn’t have to wait three days to get an answer

Here is the deal. Rolex is extremely protective of its brand and very cautious about watches purchased through unauthorized online sellers. If a watch was not bought from an authorized Rolex dealer, Rolex will refuse to authenticate it or may question its authenticity—even if it is genuine. That does not automatically mean the watch is fake; it means Rolex does not want to endorse watches sold outside its authorized network. I'm not at all shocked they would say you bought a fake watch. They are trained to tell people that.
If you asserted in the feedback that it was fake, that's a no-no. You don't know that, and you cannot say that when leaving feedback because it damages the seller's reputation and can hurt their business. eBay does not allow that, which is why the feedback was removed.
As far as the seller withholding part of the refund, I don't know what eBay will do. They will look at your account history and that of the sellers. If the seller does not have a reported history of selling fakes or always withholding parts of refunds, they will likely side with them or they may offer you a courtsey refund if they have never done that for you. I doubt it will be for the full amount. I don't know how much the watch sold for. 3k may only be 20% and that would be reasonable. It depends on the watch. If we are talking one where you paid tens of thousands for, 3k is definitely reasonable and I doubt you'll get that back.
