Ebay closed an "Item not received" case, but the item still isn't here.
I ordered an item back in October, which never arrived. I opened an "Item not received" request on November 10th of this year, and the seller responded that they went ahead and sent another item. That one didn't show up either.
I asked the seller for an update on November 24th, to which they never responded, and I just messaged the seller AGAIN four days ago on December 9th, telling them that I was going to ask eBay to step in if I didn't get a response.
I just checked the case status today, and eBay closed the case! It says, "Your request is closed. We closed this request since there's been no activity for 21 business days." Uhhh.. I may not have majored in math in college, but how is four days ago considered "no activity for 21 business days"?? Now it's too late to ask for a cancellation, and once an "Item not received" case closes, eBay (in all their infinite wisdom) won't let you re-open it! I feel like I've been scammed.
How do I get a human with a real brain to look at this?

You opened the dispute on November 10, asked for an update on the 24th while you were still within the 21 day limit for asking ebay to step in, then waited until December 9th to message them again 8 days after the dispute was closed for non activity on December 1st.
I'll bet dollars to donuts that the message you received around November 10th, was sent through ebay messages, and not responded to in the dispute itself. That was the seller's way of trying to stall you past the point of you being able to ask ebay to step in. They would have needed to upload tracking proving they shipped a replacement, to the dispute. We don't really need to know this but is the seller located in China? It is usually those sellers who use that trick.

Thanks everyone for your... feedback. To me, and every other logical person on the planet, the dialog is clear. "There's been no activity for 21 business days," which is incorrect, no matter if you know the rules or not (which I obviously did not). "No escalation" ≠"no activity." Those aren't the same words, which is what led to my confusion, and leaving an angry post. Sorry about that.
Luckily, I was able to reach an eBay employee via chat, and they actually agreed with me, stating that I was maintaining activity within my support ticket, and they gave me a full refund.

·2 years agoI'm in a similar situation with an item ordered from Europe on Dec 8. Shipper had problems finding a cost effective method and sent it uninsured no tracking. Never got the item. I opened a claim in January just to be safe, but ebay just closed it, despite regular communications with the seller.
Now I have to go through the chargeback process because it's near impossible to get anyone from ebay to help.

When you open a case you then have 21 days to come back to it and ask eBay to step in. You failed to do that, so the case closed. Your options now are to open a case with Paypal, if that's how you paid, or dispute the charge with your credit card.
Should this happen again never let a seller string you along with promises of reshipment. It's often a ploy on the seller's part to get you to miss eBay's deadlines.

You could have returned to the case on day 4 and asked Ebay to step in for a refund.
If you paid through Pay Pal, open a case with them or contact your credit card.

·2 years agoYou have 30 days...only 30 days to ask for a refund...from original purchased estimated date of arrival. Anything out of that date is "The Wild Wild West" refund.

·2 years agoYou have 30 days past the last 'estimated delivery date' shown, to open a case. You might be able to 'open' it, but seller can 'deny' refund and case will get closed. Or, item shows 'shipped/delivered' per tracking and seller can enter that tracking number and again, it will be closed.
Sounds like you didn't get a tracking number or the item showed 'shipped'?
Anyway, just go through Paypal (if that's how you paid) or to your credit card company for a chargeback.
