Ebay
Ebay is the absolute worst.
I am involved in a scam with user
They must have a bot scanning for tracking numbers and uploaded it to the item I bought.
Ebay and paypal refuse to give me my money back because the tracking says "delivered".
YEAH! Delivered to a completely different person and address.
I need to tip my hat off to this person, because this is a great scam. They have made it impossible for me to get my money back.

If you take the advice offered by @lazarustradingco , and it turns out that the seller messed up and put the wrong label on the wrong package, or made some other honest mistake. They would still be financially responsible for the mistake, but could file a Mail Fraud claim against you.

OP3 years agoThank you! I didnt mean to put them as best answer. I am new to the community and only meant to like it.
Also, I went to Fedex, they unfortunately wont give me anything since the information does not match 😔
I really appreciate your thoughtful response

·3 years agoHi @brucele03
Within a few week period last year ... I was the victim of 4-5 fake tracking number scams that involved USPS, UPS, and FedEx. [Each one was a separate order.]
I was able to get UPS and FedEx to attest to the fact that the name and address on the package wasn't mine. They sent me a statement attached to an email ... and I used that statement to get refunded.
I had to pick up the statement from the post office, as they wouldn't email it.
I recommend you phone FedEx ( 1-800-463-3339) and give them your tracking number ... AND name and address ... and ask them if your information is on the package associated with that tracking number. If they say 'no' ... then ask them to please email you a statement to that effect so that you can get a refund.
You may need to get the refund from your credit card company, since they usually are easier to reach than eBay ... and they likely are most familiar with this scam.
NOTE: As to removing the 'Best Answer' designation from the post that is recommending you commit fraud ... you do that by clicking on the drop-down menu in the upper-right corner of that post ... and then on 'Not the best Answer' (or similar). You shouldn't let that stand, as other members reading your post will be misinformed.

OP3 years agoWow. I am sorry to hear that! I am glad you somehow found a resolution. I will try this.
I have literally never felt so helpless in an issue. I also feel like I am being gaslighted by Ebay, Paypal and soon to be Chase to make me feel like I am the scammer. Nothing like going to Fedex, showing the employee how I am being scammed and they still say there is nothing they can do. UGHHH. Even the lady at the desk was furious.
Also, I definitely do not want to commit fraud but in the moment, it sounded like a great way to give them a piece of their own medicine lol. Thank you for the advice and I will certainly give it a shot!

@brucele03
A statement to that ^^^^^^^ effect (information doesn't match) is basically what you need to show the parcel was NOT intended for you. You don't need to show where it went instead. This scam has been going on for years. You will have to get similar documentation for your C.card company for when you file with them. It needs to be VERY CLEAR that this is a case of a fake tracking scam, not a simple item not received issue..
Otherwise the card company will submit the chargeback to PayPal/eBay who will simply respond with the same old phony "item shows delivered" nonsense and you will lose again.
Everybody knows about it. Nobody wants to man up or pay up, or provide you the steps to take to take care of the problem....with the exception of the people here. Unfortunately we don't control the money, and those that do don't want to give it up. Good luck, and do let us know how this turns out.

OP3 years agoI appreciate the help 😂 as it is probably a good idea to not stoop the sellers level,i t is an awfully entertaining thought.

·3 years agoSo, when that buyer opens an item not as described case, per your suggestion, what do you suggest he should return ?
Do you really think the OP should return an empty box?
OP: It's been suggested before here that you get a statement in writing from the carrier that it was delivered to another address, in writing, and go from there. Would need to determine if the seller put the wrong address on the package, or it was the right address, but the carrier erred.

·3 years agoThere is no need to prove which one. Seller is responsible (financially) for either case.

·3 years agoApologies, I went too far in my suggestion…I just hate scammers so much and the misery they cause. OP should follow Mudshark’s advice and totally disregard what I wrote.

You have been the victim of a fake tracking scam, the seller sends something, an envelope or small box with tracking to a different address, and uses the Delivered scan to win an Item Not Received (INR) dispute. eBay's automated INR system is not allowed access to anything but the scan information, due to shipping company's privacy policies. When you file a dispute and lose in the message there should be an appeal button. You have 30 days from losing the dispute to appeal, but in order to win you have to do some leg work.
You will have to go to your P.O. or a local UPS-FedEx store. You need to bring a copy of your order details page which shows your address and the tracking number with you. If you bought using a phone or tablet, you can bring that to show the clerk the order details.
You want to ask the clerk to check the label address against yours, and also to check the Package type/size weight info to see if was is appropriate for what you should have received. If the info does not match up, you ask the clerk to write a note on Company stationary saying in general that the shipping label's address was not yours, and if applicable that the package type/size/weight was not right for what you should have received. In your case have them also say the name on the address wasn't yours either. Do not ask for specific address or package info, they cannot give it out. Have the clerk sign and date the note.
Once you have the note, you can appeal the dispute ruling, or contact ebay through their Facebook or Twitter social media pages. (links below) You can write out what happened and what you found out, and add a CLEAR photo or a scan of the note to an appeal or message. If you go the social media route which is recommended, because the reps know about the fake tracking scams you will need to have the seller's username and the ebay item number. At the end of your message give them your real and ebay username.

In the future I strongly suggest that you check the feedback profile pages of each seller you intend to buy from, before bidding on or buying their items. On the profile page if the seller has received neutral or negative feedback, click on the numbers of them to read only those comments. Never go by a feedback percentage alone.

·3 years agoeBay will believe the carrier rather than the buyer (or seller). If the online tracking report for the tracking number shows delivery to the same zipcode (5 digit) as what the buyer gave for the shipping address, it will presume it is to that shipping address. That presumption is rebuttable by documentation from the carrier that it was not delivered to that address (the document does not have to give the actual address but merely state it was delivered elsewhere than [your shipping address] since there might be privacy issues). This covers errors by the carrier in mis-delivery (the carrier can tell this by matching the GPS coordinates of the delivery scan with the facts on the ground) and a scamming seller who sends a low value package to another address in your zipcode. See here about appealing the decision if the carrier can document such a problem: https://www.ebay.com/help/buying/returns-refunds/appeal-ebays-decision-return-missing-item-buyers?id=4039&st=12&pos=2&query=Appeal%20eBay%27s%20decision%20about%20a%20return%20or%20missing%20item%20for%20buyers&intent=appeal&docId=HELP1308
On the other hand, neither eBay nor the seller is responsible for the theft or other disappearance of the package from your porch, doorstep, or other place at your address. You can try your homeowners or renters insurance agent to see if that would be covered at what deductible.

OP3 years agoI appreciate you taking time to respond!
Fedex wont supply me with any documentation since the tracking number isn't in my name nor does the address match. When I ask Ebay or Paypal to do that, they tell me they dont have the power to do that.
Ive never felt so helpless. Ive provided photos that the item in the tracking photo doesnt even look like my package. (Its cylindircal, my package is square). The house is different, the weight of the package is different. Its so shockingly clear that I didnt receive my package but Ebay, Paypal, Fedex all want to point the finger at someone. This has been a miserable experience.

·3 years agoI have a package coming from Fed Ex on Wednesday. I get quite a few packages from Fed Ex.
Fed Ex sends an email to you on your phone or your computer day of pick up of package. Then Fed Ex sends you updates on the travel of package....estimated day of delivery....then you get more emails from Fed Ex on day of delivery plus a time frame. True, name & address may not be on the emails...but if you are getting emails then you will know day and time frame it is being delivered...mine is a 4 hour window of delivery.
Then when he gets to my apartment he rings the doorbell and hands package to me...sometimes I need to sign and sometimes I do not.
I don't know where you get photos of package or weight of package...I never see them in my emails of a package from Fed Ex.
Curious, did you google the address to see where you package went...it will show if its a house or building or something? And the name of the person...?
As a last resort....since you are saying eBay cannot help...you can go online with you banking debit or credit card that you used and "dispute" the purchase...it usually takes 2 weeks for a refund from the bank. Keep in mind that it is a courtesy from the bank and usually will only do one dispute in a monthly cycle...if you made disputes with Uber, door dash, Amazon, etc. all in a monthly cycle it made be a little more difficult to obtain a refund.
