Chargeback on sale
Hello all,
I sold an item worth over $1000 , it went through authentication and the buyer says it arrived damaged. They started a case without requesting a refund first and they lost the case. Ebay did not grant the return. Now they are saying they are going to call their bank and get a chargeback.
I don’t agree with their reason for refund the buyer says that a hard plastic slab that the card was in was chipped. Which is basically impossible. I don’t believe him but I’m fine with taking the return now that he’s told me he’s gonna file a chargeback.
The only thing is since he lost the case all I can do is issue a refund, I can no longer start a return. So the only way we can do this return is out of ebay right? He ships me the item and I issue the return. Which is sketchy as hell but I don’t know what to do. He could just send me an empty box and use the tracking as proof of return. I really don’t want to accept the return but I feel I have to now.
please if you have a tip it would be very helpful.

·3 years agoYou’re protected from chargebacks. eBay will be the one to eat the chargeback since it was authenticated by them.

·3 years agoYou should still be covered under ebay seller protection and the authenticity program policy as ebay was the one to deliver the item damaged to the buyer.
Ebay allows buyers 3 days (trading cards) to open a claim to return on a final sale if the item arrived damaged.
My guess is the buyer tried to open a case after the 3 days so ebay did not allow a return. So the case for item not as described was already decided in your favor Ebay policy claims that your are protected if the buyer opens up a payment dispute.

·3 years agoI'm pretty sure that an item that was sold through the Authenticity Guaranteed program offers protection to you against any claims.
According to their program, ebay (claims to) have your back.
You are NOT required to take the return nor should you have to worry about a chargeback:
Returns with Authenticity Guarantee
If a buyer wants to return an authenticated item, your return policy as stated in the listing will apply. Authenticated items are covered by eBay Money Back Guarantee, assuming all other eligibility criteria are met. For full details, read our eBay Money Back Guarantee policy.
When returning an item, the buyer will send it back to the authenticators who will check that the item is still in the same condition and has all relevant accessories. Once the item has been re-authenticated, it will be returned to you and the buyer's refund will be processed.

You will probably be contacted by the buyer's card provider before they issue a refund. If they allow emails to be sent to them, send them a link to the original listing the photos do not show any chips in the slab. You can send them a link to ebay's Authentication process as well. It will show the Card provider that the card was authenticated, and they the buyer knew that they would not be allowed to return it. (link below)

Also state that you want the buyer to return the card with signature confirmation and insurance also that you want the buyer to send you the card provider the tracking number.
If they do that then you can have the P.O. hold the package for pickup. If you have them still, bring copies of your photos showing the card in the slab from front and back when you pick up the card. A
Open the package in the P.O. in front of the clerk, in case the person tries a switch or sends something else. If they do that immediately open a postal fraud case with the USPS inspectors. Have the clerk write a note on USPS stationary stating what was found, and have them sign and date it. Send the info to the card provider.
If they send the card via FedEx or UPS, again request insurance and signature confirmation. Open the package in front of the driver, before signing for the package. You should have photos from the ebay listing. If things aren't right have them write a note and sign it with their name employee number etc. and refuse the delivery. Transmit the info immediately to the card provider.
By doing the above you may avoid being scammed from receiving an empty package or a different card etc. It may also make the buyer think twice about the charge back, since they would be responsible for the return shipping cost.
In the future, I too agree that you should have the shortest return time frame as possible, instead of a No Return policy. I would also suggest not taking photos of slabbed cards that completely fill the frame, so the hover to enlarge option can show the slab edges clearly. You get to post enough photos that for expensive items you can take the time to carefully photograph every angle of an item.

·3 years agoThis is a real issue with authenticated sales. If the item passes authentication eBay considers it to be an 'as is' sale, returnable only if the seller accepts returns. I know it doesn't help this time, but I suggest you change your return policy on authenticated items to allow returns. In the current case eBay is out of the picture. All you can do is negotiate directly with the buyer. If the credit card allows you input in their decision you can also communicate that you want the item back. I hope it works out for you.

·3 years agoWhenever a buyer requests to return an item they claim is damaged you only have 2 choices.
You can refund in full and let them keep it or you can accept the return and provide a return label and refund by 2 days when tracking shows you received it back.
Now that eBay is out of the picture if they go to their credit card for a chargeback the card co will see you refused to accept the return so they'll give the buyer their money back and you get slapped with a $20 chatgeback fee.
In the end you will lose the item and the payment they paid plus $20.

OP3 years agoI never refused to accept their return. They went straight to filing a case because it is an authenticity guarantee item. I never had the option to accept a return. It went from the buyer filing a case, to the buyer losing the case, to now with no option to start a return.
