Case closed before delivery of item:

I had purchased this item for $526.00 from an eBay seller called a MAP Sensor for my 1974 Mercedes Benz 450slc D-Jet M117.982 engine C107.024 coupe, as I had also described this to the seller. Then soon after I discovered that it was the wrong part for my particular car engine D-Jet M117.982. Before the part was delivered, I filed for a return/refund. My request was denied and the case for this item was closed before the part was delivered. When the part was delivered, the first thing I noticed was the black cap/cover is missing. The cap in place shows this unit is true, but once removed, it shows/exposes a crucial adjustment may have been tampered with. Making this MAP sensor useless. The piece missing is the black cap at one end of the MAP Sensor, exposing a calibrating adjustment. According to the Mercedes manual and a Bosch professional, the black cap that was removed should never have been removed. The black cap ensures and guarantees that this device is calibrated to certain specs from the factory and has the same correct specs from day one. The function of the Manifold Absolute Pressure sensor on a 1974 Mercedes is an electromechanical device, not a solid-state electronic sensor. It consists of a diaphragm, an armature shaft, and coils. The engine's vacuum (or lack thereof) changes the position of the armature, which varies the inductance of the internal coils.This changing inductance is a critical part of how the ECU determines the injection pulse for the fuel injectors. It is used in combination with signals from other sensors to calculate the correct amount of fuel to deliver.
All I am trying to do is to get my car to run properly, so I can drive it!
The Seller and eBay decline to accept a return and refund of my $526.00. Right now I feel like I am being ripped off and this is not right! What would you do, or for that matter, what should/can I do?

·11 months agoBuying the wrong part would have been on you, especially if you bought from a seller who doesn't accept remorse or buyer error returns. However, you caught a break with the part arriving not as described. But by not knowing EMG, or the policy on buying/returning car parts, you shut the door on your ability to return for a full refund.
Your best option now is to go to your payment source for help.

·11 months agoIf you chose "Doesn't Fit" as the reason for return that is considered a remorse reason by eBay and seller has the right to decline a return for that reason.
Also do not open a return request before you even have the item to return.

Yes, I do know this now. The case being, I didn't find out it was the wrong part till the part was already
in transit. I've got a 1974 Mercedes 450slc I have been restoring and I learn/discover something new about it almost every day. My point being is that the seller had to have known before me that his MAP sensor wouldn't work in my car! The sellers ad was misleading to me because of the C107 number and the M117 number are supposed to have a . and 3 more numbers after that. The C107 stands for the type of chassis and the M117 stands for the type of engine. My car has a C107.024 chassis and a M117.982 engine. Plus, the box was wide open when I got it delivered, nothing was missing. The only thing missing was the black cap cover for calibration from the factory. Once removed, the item/sensor is useless anyone. The seller should have known that too! It's wrong!
At a store, you buy the wrong item you return it and get your money back. There should be no difference here. Especially, when the seller texted me (through eBay) saying he runs an honest business, that he doesn't cheat people, and that he guaranteed the part.

·11 months agoSeller just sells parts, he's not the Mechanic that diagnosed your car saying this was the part you needed. Seller just sold the part by the part number that was on the box, the part that YOU originally ordered. Parts Guys are not Mechanics, the Mechanic, YOU, needs to know which part they need. YOU discovered it was the wrong part YOURSELF after the fact. Biggest mistake you made was trying to cancel the order after discovering YOUR mistake. Mistakes were made, and you've been giving some OK advice so far to attempt to correct YOUR mistake. Good Luck.

I made the mistake, and everyone makes mistakes..... when you go to a store and buy (say) something for your home, but when you get there and discover its not going to work out in your scheme of things. Well, you catch my drift. Anyway, you can take it back to the store with no problem and get your money back. This is the same thing, ebay is a store and they should treat their customers the same way. There should be more of a balance between the seller and the buyer. Because from what I see, the system ebay has in place now is geared for the SELLER. Which is B*** S*** ! I never read the rules before this encounter, I never thought I would have to!

·11 months agoNo, eBay is not a store. It's a site where individual sellers all over the world list goods for sale. It has a Money Back Guarantee that's very buyer-centric and linked in every listing. If you didn't bother to read up on it before blindly plunging ahead, that's on you.

Some things I do not accept returns for "buyer errors".
Both choices are within "eBay" selling policy.
"Accepts returns", or "does not accept returns" is clearly shown in each and every listing.

·11 months ago@wafane_12 in life, there are rules for everything and not knowing them can be detrimental in some cases.
buying from a brick and mortar is not a righteous comparison.
at least now, since ur discovery of dissatisfaction with buying on eBay, you can go to a brick and mortar instead.

What kind of return/refund did you file? If it was for not as described before you received it, you may be able to file again. If you can't then you should try filing with your credit card provider. In the future make sure what you order is what you need. If it turns out to be the wrong item you have to wait until it is delivered before you file a dispute.
FYI, You can only request a cancellation before an item is shipped, but the seller has to agree to the request, and they are not required to do that.

You shouldn't have opened a return case before you received and inspected the item. I'm presuming that you chose 'doesn't fit' as the reason for the return. EBay considers that to be a remorse return, which is subject to the sellers return policy. Unfortunately you can't now change the reason for the return to the part being defective. Your only recourse it to dispute the charge with your payment source.
