Calling for the help of the community - Help me stop this seller from scamming other people
Dear community,
Gonna make this short. But for almost 2 months now i have had a real hard time with a seller here :(((
Bought a couple of black oaklye eye jackets from a seller back on February 2nd
On february 12th i recieved screaming yellow oakleys.
I inform seller of wrongly sent item
Today is 11th of april 2 months have passed. I still have the yellow oakley glasses and still no refund was issued. Only his latest communication
My fault
I believed his stories and didnt issue a refund before after the 30 days have transspired. Now im left with nothing but a bad experience.
The seller
He said the glasses were by mistake sent to australia, then were held in customs on their way back. He isn't providing me with information so i can return the glasses, and neither issues a refund as promised multiple times. Spent 270€ for glasses I never recieved. Seller won’t send return information and is dodging any form of refund. He used his good reviews as leverage to let me believe that i should be worried.
eBay
I wrote a review, which was according to their customer service falsley removed. After i asked them to reinstate them after they acknowledged wrongdoing, they say it cannot be reinstated. Worst part is. He still is selling on eBay, and had a sale after my “purchaseâ€. I’m both disappointed with the seller leaving me a frustrating experience for 2 months now and eBay for letting this continue.
As I have been scammed I really hope no one else is going to fall in to the trap of this bad seller Let alone why eBay is continuing letting him do business. Can anyone please help?

·2 years agoEbay is not going to suspend a seller's account because they sent the wrong color sunglasses.
As others have noted here, had you opened a case with ebay within the given 30 day period, and followed the instructions, you would have been refunded. Many high volume 'power sellers', 'top rated sellers', etc. seem to have the ability to get negative feedback washed away. Ebay is not anxious to lose or suspend an account when it's a seller they're making a lot of money from.

I'm not surprised. The seller doesn't have to refund until you return the glasses. If they didn't provide a return label or a refund then you open a return case and ask eBay for help. You have 30 days within the delivery date to do that.
If the delivery date was more than 30 days ago file a dispute with your payment source.

Had you gone to your purchase history after the seller's first response, and clicked on the More actions button, then selected Item doesn't match description or photos, that would automatically have opened a dispute for you. The dispute would appear on your My ebay summary page and you would have been given a date by which the seller would have to either send you a return shipping label, or issue a refund. If they did not respond to it, one day after the date you were given, you could have used the Ask ebay to step in button, and a refund would have been processed.
Because you did not file a dispute there is no record of an issue on ebay, so they will not take action against the seller. Even if you had filed a dispute and won, ebay is not going to kick a seller off the site for one issue. They do however, give the seller's account a defect which for a low volume seller can affect their account, and cost them the final value fee charged by ebay for the sale.
Because your feedback probably said you did not receive the item, that is possibly why the seller was able to get the feedback removed. Had your comment said I was sent the wrong color, and the seller kept making excuses, it would probably still be there.
The since it has been so long since the sale was made, the seller has probably blocked you, from communicating with them, and that is why you are not getting any answers.

·2 years agoAs noted in the other post, you have let your eBay protection expire so your only recourse is through the payment processor(s). For your future reference, Here's a link to eBay's buyer protection policy, which they call the "Money Back Guarantee":

If you paid through Pay Pal, open a case with them or contact your payment source.
