Buyer Requests a Refund on Suspicious Sale
I purchased a gaming monitor that was listed as "NEW: A brand-new, unused, unopened, undamaged item in its original packaging..."
When I received the item not only was 25%of the needed protective foam broken off and missing, but the individual wrapped the base and mast of the monitor in a towel and left it dancing about in the box on top of the monitor's screen, instead of placing those parts in a separate box for shipping. The monitor was received catastrophically damaged and inoperable. Upon further inspection I found a rear panel and coupler were missing and that there was literally dust in the rear of the item proving it had been used. If I had to guess I'd say whoever owned it got mad and through something at it during a "rage quit" incident.
I requested a refund, and they said they are submitting a claim with the courier (UPS). What does that have to do with MY refund? I shouldn't have to wait for UPS when clearly they sent me a damaged item from jump that they misrepresented as NEW.
I think this guy is trying to scam UPS to not take a loss on an item they already knew was damaged. Do I have to wait for their claim to go through with UPS or can I demand the refund now? Also since I would have to return it to the seller, do I have to pay for shipping again?

OP3 years agoSo last annoying question, I promise.
How do I close out this thread now that the problem has been resolved? 🙂

·3 years agoWhose label did you use to return it? You always use the label they provide. If you provided the label did you have a place to upload the tracking number? I would call eBay and ask them to make the refund since tracking shows delivery was attempted.
nique_parker
OP3 years agoYes, I provided the tracking number. I was directed by eBay to send the item back, but never received a shipping voucher to do so, so I figured I had to do it myself.
Good thing is I just got word and confirmation last night that the refund is on the way. So the problem resolved even though it took longer than it needed to. No fault on eBay of course.
The main negatives are that it still cost me $77 in shipping, AND the item is headed back to ME! What the world am I going to do with that? :-S

·3 years agoYou got your refund and the item is coming back to you. When you get it, take photos and post it on that site the FREE and have local pickup. Meet the new buyer at a very public place. Try to recover as much of your 77 dollars that you paid in shipping. AGAIN, meet in a public place like a busy McDonalds or supermarket. Get cash and go out and have a nice lunch.

·3 years agoUPS used to make three attempts, but I'm not sure if that's still the case.
Ebay never shuts down a seller's account for one infraction, nor should they. Since the seller forced eBay to step into the return they got a defect on their account. If they accumulate several of those penalties range from higher fees to eventual account suspension.

OP3 years agoI just don't understand this. It's been over two weeks since I sent the item back for a return, still no movement either from the seller or eBay. I even sent a message to the seller letting him know that UPS has attempted to deliver the item, and now he chooses not to respond. Totally ghosted. eBay knows I shipped the item. Shouldn't they be attempting to reach him as well?

·3 years agoeBay considers the failed delivery attempt to be the same as delivered.
Proof of delivery for returned items
Returns should be sent with tracked shipping that can be independently validated.
We require all of the following to prove a successful return delivery:
Get this: Just
1. get on Facebook with eBay here,
2. get eBay to see the delivery attempt, and
3. get your refund out of the seller @nique_parker.
Get it?

OP3 years agoThanks! And you are right. Just received word that my refund is inbound. Thank you for your reply and assistance.

·3 years agoNever fear. If it's refused or comes back to you as undeliverable, eBay counts it as delivered and will refund you.
nique_parker
OP3 years agoThank you so much for responding. I can't believe that it has gotten to this point. Do you by chance know how many attempts UPS may make before they call it quits?
I hope eBay shuts down their account for this behavior.

OP3 years agoOkay, this has gone from annoying to frustrating. The item was sent back, it arrived at the location on Friday but I guess no one was there to accept it. UPS tried again on Monday, but supposedly there was a security issue preventing delivery. Today was a third attempt and yet again no delivery. Has anyone had this type of thing happen before? At this point I'm getting the feeling that the guy isn't going to accept it and may feel that he doesn't have to. How many attempts before UPS just says forget this, and decides to send it back to me because they can't deliver?
nenu-5410
·3 years agoIt sounds like you paid for UPS yourself. Because if the label came from the seller @nique_parker eBay would have refunded on the first delivery attempt. And if so, you won't get a refund when UPS returns it to you after their third delivery attempt, as eBay considers you responsible for that delivery, since you paid for it.
But if it was an eBay-issued or seller label, leave another private message for eBay again at Facebook here, and ask eBay to review the tracking number, to get your refund.
nique_parker
OP3 years agoYeah, eBay told me to return it, they didn't say anything about the Seller sending me the tracking details. Just said send it back and upload the tracking number into their system. It would have been nice if they had said that the Seller was paying for the shipping.

·3 years agoIf you opened a return request, the seller should have sent you a label to return.
If you've started a return and the seller has not sent a label to return you can ask ebay to step in
Ask eBay to step in and help for buyers | eBay
If you are just communicating through messages, That is not the way to go about it. You need to open a retrun stating the item is NOT as Described. Follow directions.
Returns, missing items, and refunds for buyers | eBay
No you do not have to wait for the seller to get a refund through UPS.

OP3 years agoSo, I submitted the formal request for a return and was told to wait for the Seller to respond. then it was put on hold because the Seller submitted a claim I guess. The problem now is that eBay says it sent me an email asking for additional information, but I have received no such email. I've checked the Spam area and Deleted Email area, and nothing. There is also no direct way to contact eBay to inform them that I have not received the email. Have you experienced this before? How do I contact them directly?
nenu-5410
·3 years agoActually, that message was for your seller @nique_parker but eBay sent you a copy as well, telling them to look for an email from eBay.
You can ignore it, as eBay is just setting up your seller to fail, and will force a refund from them in 5 days.
nique_parker
OP3 years agoThank you for the response. I was really starting to worry as my unit's flood response operations have kept me way busy and I thought I had missed something. I hope you are right about eBays intentions. The scammer actually tried to tell me that eBay wants us to continue working towards a resolution, but the only resolution I want is my money back and for the seller to ship the item back. Then they can deal with UIPS if that's what they want to do. But I'm pretty sure that as soon as UPS realized that the item wasn't packaged properly, they are going to step away. Their ad was false, and they either shipped it damaged, or shipped it in a way that it would be damaged in transit. I am 150% sure of either one being the case.
nique_parker
OP3 years agoSo quick question if I may? I've been directed to return the item for a refund which is great, but realistically should I also expect to get my money back for shipping the item here AND back? Right now the total for shipping has cost me a tiny bit over $150 on top of the cost and tax, so wondering if I'll be refunded completely or not?
Lastly wanted to thank everyone here for their knowledge and assistance on this incident. 🙂
nenu-5410
·3 years agoNope, you're not responsible for return shipping. And do not pay it yourself, as you won't get reimbursed.
Instead, leave a private message here for eBay on Facebook, and tell eBay that you need the seller @nique_parker to send the prepaid return label.
