I just closed my account as eBay no longer has Buyer Protection. I just had a pair of Bose earbuds stolen by a FedEx driver, who posted proof of delivery as a field. FedEx believed the items were not delivered and allowed the seller to file a claim. eBay denied me protection stating "it was delivered according to FedEx" even though the proof of delivery picture showed no package, no house, just an open field. So, what would happen with a $5000 purchase? I will not be screwed again so I closed my account after 30 years....

I just received a audiophile CD Player in damaged condition due to the seller ignoring my request to pack with adequate sized box and packing materials to protect a sensitive optical device weighing 20lbs. It did not work properly and I contacted the seller to start a return which he accepted. As soon as the seller received the item he blocked my emails on Ebay and accused me of filing a false claim. He refunded my purchase partially and kept a 15% restock fee and return shipping. If I hadn't pursed this theft from me by filing a claim with Ebay, he would've gotten away with his grift. Seller never proved the returned item was working. Wouldn't supply a video or otherwise. SO, long story short: I agree with the poster that Ebay buyer protection is gone, at least it was in my experience seeing Ebay let this deadbeat seller go ahead and take money from me after accepting a return.

You have already posted three threads of your own about how much you hate eBay. It really isn't necessary to state your unhappiness on someone else's thread.

If you plan to start a "major horrific" lawsuit against eBay, please come back here (on your own thread) and let us know how it is going. We would all like to be kept updated on that.

Thought what through? I'm not sure what you are saying.

In my 27 years of selling on eBay and with the hundreds of purchases I have made from all kinds of online venues, I, personally, have never come across an unscrupulous delivery person. Not saying they aren't out there; probably are, but I just have never had one. If I honestly thought a driver was stealing my packages, I would certainly check into it and if I thought I had proof, I would contact the company they work for.

@user4628 wrote in his opening post that a Fed-Ex driver had stolen his ear-buds. But he did not explain how he came to this conclusion and whether he has proof of this. He also stated that he has had several packages stolen by delivery persons but again, no explanations of how he knows this or whether he has proof.

@user4628 stated he is leaving eBay because there is no Buyer Protection. Well, yes there is. There is buyer protection for "items not as described" in Bay's Money Back Guarantee. But as far as items allegedly stolen by delivery people, I'm not sure exactly what he thinks eBay should do about that since they aren't responsible for theft.

With all the negatives you have left for sellers for transactions you were unhappy with, coupled with the fact that you claim you have had many items stolen by unscrupulous delivery drivers, it's probably for the best that you are leaving eBay. Thank you for letting us know.

Op. You must have some of the worst luck on the platform that I have seen in a while. Maybe it is for the best that you move on, since apparently a lot of sellers disappoint you for one reason or another.

It's been my understanding that if a Claim is settled neither party can leave feedback.

So if a buyer is leaving negatives for transactions, they did not open a Claim and get a refund.

I guess some people would rather be angry than solve the problem.

I had one like that. The only buyer to ever leave me a red dot. On an item with free returns. Never opened a return, just dropped the neg and that was it. I messaged and replied to the neg. Nearly 2 months later I get a verbal abuse message as a response. But it was all their fault. I don't refund buyers that drop a neg and don't even bother trying to open a return. I don't play that game. *shrug

I've read all yours and others replies and looked at your feedback left for others....Whoa.

In my years of buying on eBay i've only had 3-4? deals go sideways and The Money Back Guarantee has made me whole every time.

Even on a false tracking scam if one knows which reason to use (not Item Not Recieved) the MBG is very good protection for the buyer.

You were protected you just seem to have gone about it the wrong way.

Try to take a step back and let the anger emotions subside a little before dealing with bad transactions.

My experience with FEDEX Ground is so bad that the only items I will order that ship FEDEX Ground are Ebay supplies.

If an Ebay listing says FEDEX shipping, I pass.

How did you discover that a FedEx driver stole your earbuds?

[There is a very common scam that results in tracking showing that an item was delivered to the buyerâ€™s ZIP Code â€¦ but the buyer actually receives nothing. This scam can occurs on any online selling venue ... using any shipping method. I've been the victim of it on Amazon, eBay, and Walmart so far ... using USPS, FedEx, and UPS shipping ... most recently in the past week. If you believe you have protected yourself from being screwed by closing your eBay account ... you are sadly mistaken.]

EDITED TO ADD:

Since you haven't come back to answer my original question to you ... I am going to assume that you merely made an educated guess as to the reason your item wasn't delivered to you. In order to verify your guess, I recommend that you do the following:

Contact FedEx and ask them whether your name and address were on the package associated with the tracking number you were given. If they answer in the negative ... you know that you are the victim of the 'Fake tracking number scam'.
Then phone your credit card company and ask to be transferred to their Fraud Department. Tell them you didn't receive the item because your name/address were never on the package ... and you were the victim of the 'Fake tracking number scam'.
Ask them to reverse the charges. [They will be able to verify your accusation by checking directly with FedEx.]

How would the delivery driver know what was in the package unless a label were slapped on the original Bose box which is unlikely. Chances are you bought the earbuds from a China based seller who put a different address in the same zip code you live in, on the label. Which is commonly known as a Fake tracking number scam.

Did you check the seller's feedback profile page before buying the buds? Maybe you should now. look for comments about deliveries where people didn't receive the items. They didn't file disputes which is why their non positive feedback were allowed to remain.

Due to federal postal privacy regs. ebay cannot access the actual label address when their initial automated system checks a tracking number for a Delivered scan. An appeal of the dispute would also probably be denied as well even though a real person handles them for the same reason. This scam has become common because the scammers know about the postal regs. and ebay's inability to get the info needed to overturn the initial decision.

What you can try doing, is to contact FedEx, tell them what happened and get them to email you the GPS coordinates if they record them. Then contact ebay through one of their social media platforms (links below) You will need the seller's username and the ebay item number write out what happened saying you were the victim of a fake tracking number. Post a copy of the email with the GPS coordinates and one of the FedEx info with the photo. and ask the rep to check it against your order details address by going to www.gps-coordinates.net to look it up, or they can do a google map search of your address to compare the photo from FedEx to one of your location. If the seller's feedback has mentions of delivered items not being to the buyers addresses mention that in your message as well. sign the message with your real and ebay username.

If a social media rep can't help you, your last option would be to contact your credit card provider. Tell them you were given a tracking number that was not addressed to you but had a delivered scan from somewhere in your zip code. They may want the GPS or Google map info too as proof.

Hopefully, when you filed your claim you did not insist on "Item not Received" (INR). The claim will be presented to eBay, who will respond with the same "fake" delivery confirmation and you stand to lose again. The correct thing to claim would be FRAUD/fake tracking/shipped to wrong address scam. If you did not, contact them immediately and update your claim.

Presumably, you filed INR with eBay. In the instances where there is 'delivery' confirmation associated with your order (EVEN IF IT IS FAKE) the eBay Money Back Guarantee is going to be a giant FAIL, unless you know how to proceed. Unfortunately, eBay has no published policy for victims of this scam that has been going on here for years, and the natural thing for victims is to file INR.

If you have been shopping on eBay since 1996, you are lucky for this to be your first experience with the "fake tracking scam". You can get redress, but you will not find the procedure on eBay.

If you look at my profile it shows I joined in 2001. However I had registered in 1998 with an AOL email address but moved to a location where AOL was not available. Back in those days transferring an email address from one provider to another on ebay was next to impossible. So I registered this account in `01.

Buyers never lose buyer protection. Plus your beef is with FedEx not eBay.

Announcing your departure to fellow eBay members is totally unnecessary. Plus since you had a recent sale, eBay wonâ€™t close your account until past the time for a buyer to open a return or file a dispute with their payment source which is at least 60 days.

If this is happening to you more than once, you are choosing the wrong sellers to buy from. Are you checking seller histories? Are you looking at feedback? Are they dropshipping?

I had a package from a hearing aid company come empty. Talking with the seller, he thinks someone in the delivery chain saw "hearing aid shop" on the return address and decided to open the box and steal the contents (a hearing aid is a very high value item that is easily concealed). I showed photos to the seller, he said he uses an adhesive label and no tape over it. Yet the package I got had tape over the label. It appears they cut it open from the bottom, stole the contents, and then taped around it and dropped back in the delivery stream.
The thief didn't get anything of real value though, just a inexpensive earwax protector for a $3500 hearing aid! And that's why he always uses insurance when sending high value items.
