Bought a Scam Listing and Need Assistance
Hello all, I just today bought a scam listing shipping from Pakistan. The listing uses photos stolen from other, legitimate listings on the platform. The seller denied my cancellation request. What can I do here? I tried reaching out to eBay support on twitter but have been seemingly overlooked. It's for the tune of $488 and I really can't afford to lose that.
Edit: Currently talking with support on twitter.

·1 year agoDo not do anything until you come back here and let us know what is going on. Does it say delivered or is it still in transit? If it's in transit, you have to wait. If it says delivered, it's the fake tracking number scam. Come back hear and let us know. We can then advise.

OP1 year agoIt's fake tracking number scam.

·1 year agoFile item not as described. Print out the return label, slap it on an empty envelope and mail it back. The seller will get back exactly what they sent you, which was nothing...

OP1 year agoPost office still has not replied to my case through email for the second piece of evidence. My nerves are shot.

·1 year agoWhy do you need a second piece of evidence? Is eBay asking for this?
You mentioned that you already sent a statement from USPS.
"they require is a contradictory statement from the post office on my behalf (Which I did get and send)"

OP1 year agoThe support rep said it would not hurt to get as a another piece of supporting evidence. Frankly what the post office gave me looks like something anyone could draft up, but I did send it to the ebay twitter support. Like I mentioned in a previous post, ebay twitter support wants me to go through the INR claim even though it's marked as delivered. And THEN get back to them if (when) my INR appeal fails. Which I am skeptical about on the whole.

·1 year agoOk, that sounds reasonable. A nice statement printed on USPS Letter Head with a point of contact should make things go easier. Good luck!

·1 year agoHi @highway35diecast
If you have a statement from your post office that your name and address was not on the package associated with the tracking number you were given … then the easiest thing to do is to phone your credit card company.
Ask to be connected to their Fraud Department and let them know you are the victim of the fake tracking number scam. Request a chargeback. [I’ve been the victim of several of these scams.]
Your credit card company will be able to get additional information from USPS if they need it.

OP1 year agoI used paypal because I do not have a credit card. I wonder if my bank would be able to help me if all else fails.

PayPal is MUCH easier to deal with than eBay regarding this scam.
If you file an ‘item not received’ claim … PP lets you choose ‘Package shipped to wrong address’ as reason for not receiving the package.
eBay is still limping along, trying to deal with this VERY common scam that’s been around for YEARS.

OP1 year agoOkay. Would you say I try through ebay and then go through paypal afterwards if ebay fails so I can fall within the 30 day period on ebay?

Yes, the best method to have the most chances to get your refund is:
eBay first, if that fails Paypal and if that fails your credit card.

·1 year ago@highway35diecast
Yes … IF you’re willing. eBay will drop the case as soon as you involve another agency.
I also recommend you get a credit card to attach to your PayPal account … especially since PayPal shrunk the time allowed to file an ‘item not as described’ claim to 30 days, which is the same as eBay. There are situations where that may not be enough time to ensure a refund.
[I have a credit card as my Preferred payment method in PayPal … and have PayPal as my only payment method in eBay. That’s always worked great for me.]

·1 year agoAsk the social media people how that plays out? Typically when you file INR, the buyer responds with tracking showing delivery and you lose, but eBay social media agents are telling you to do that

OP1 year agoEven with supporting information, the twitter support is still insisting I go through the INR process. I am not really sure what to do. The twitter support says they will be on my side if the appeal through ebay fails and that usually all they require is a contradictory statement from the post office on my behalf (Which I did get and send). Basically they just want me to go through due process first. What is everyone's experience with this, if you have any?
pikabo-icu
·1 year agoWell, I suppose go ahead and do that.
If you have that letter from the PO upload it into the case.
The problem is, you will need to get eyes on it because the bots will side against you due to the tracking. If it sides against you APPEAL and maybe jump on chat and have a rep look at it.
If that fails then it's back to social media.. SIGH
highway35diecast
OP1 year agoThe rep said that they have all the information from the interactions from my case to take my case to the department head if the appeal fails which, which knowing eBay, it will. I need to send an email to the post office to get a second instance of evidence as well just to have a double confirmation.
stephenmorgan
·1 year agoThat is your evidence that you did not receive the item and with this you should be able to get refunded.
Unfortunately like the twitter support alluded to, the appeal through eBay may fail. This is because the appeals process apparently is not able to evaluate the evidence you provide and only evaluates if a tracking number is delivered to your Zip Code.
I sounds like they want you to appeal and if your still denied to get back with the twitter support.

OP1 year agoAlrighty, the package has been marked as delivered. Obviously, no item has been received. Tracking number originated from my state. Marked as delivered at 12:49 PM on my front porch, which didn't happen. I have the date and time of like 5 packages legitimately being delivered to my address at 4:09 P.M. Any suggestions?
pikabo-icu
·1 year agoYes...
Fake tracking number scam.
Detailed info on how to fight that on this link https://community.ebay.com/t5/Buying/Sketchy-seller-scamming/m-p/35050675
It takes a bit of effort but you can get refunded.
highway35diecast
OP1 year agoThank you. I am reading Mudshark's reply on another post as well that talks about getting a memo from a post worker that confirms the package was delivered to an address that was not mine and that it does not weigh what a package like mine should weigh. If this were you, would you also get that to strengthen the case? Or would you just go the USPS email route as described in the topic you linked.
pikabo-icu
·1 year agoYES! Absolutely..
Mudshark gives excellent advice..
Gather everything you can and contact eBay on their social media.
They are familiar with this scam and should know how to assist you.
Make sure to send them a message not a post.

If you don't receive the item by May 23, go to the item in your purchase history and click 'I didn't receive it' under More actions.
If you receive something that doesn't match the description, go to your purchase history, click Return under More actions, and select that the item doesn't match the description as the reason.

·1 year agoRight now, not much you can do until a day after the estimated delivery date.
highway35diecast
OP1 year agoAt least in this case, that's may 22nd at the latest. How would I handle a claim in that situation, if you don't mind me asking.
pikabo-icu
·1 year agoWell if nothing arrives by that date file the normal Item Not Received case..
If you get the fake tracking that shows something delivered , somewhere but not to you, you can do a search on this forum for details on how to handle it.
It will require some work on your part. Sadly, it's happened a lot so there are ways to deal with it.
Don't get discouraged yet, people are allowed to use photos of other sellers so unless it's a "one of" item, they may ship it or drop ship it..
Hopefully you will get your order. If not you can come back and ask for help dealing with it. BEFORE taking action.

·1 year agoThe one thing you have to watch out for is the fake tracking number scam. If the tracking shows delivered but nothing came, do NOT file an item not received case. You will lose. Instead, file an item not as described case.
Did you pay by credit card? If so you can file a charge back if you lose with eBay's protection.
Why would you buy such an expensive item from there? They may be busy with a nuclear war with India soon.
highway35diecast
OP1 year agoI paid with paypal. I do not have a credit card yet. May I ask the difference between an INR and INAD in this case? I mean obviously if it shows delivered it will default to a win for them with INR. How should I posture the INAD in this situation? Buying it from there was unintentional. Monkey brain had thought it was in the U.S. but obviously this is not the case.
simba6
·1 year agoYou just file an item not as described case. The seller won't foot the bill for a return label and if they did, send back anything. INAD is a not as described case. It's correct as fake tracking number scammers would not send the actual item to some other address. They send some worthless item.
As stated you will have to wait and see what happens next. Come back here and let us know before you do anything.

·1 year agoINR: Item not received. When the item is not received by the estimated due date as seen in the listing, the buyer has 30 days to open an item not received case, per the eBay Money Back Guarantee.
NAD: Item is not as described. When it does arrive, but is not as described, the buyer has 30 days to open an item not as described case, per the eBay Money Back Guarantee.
After that case is opened by you, your seller has 3 days to respond. His response can be: a) to send you the postage to return the item . Due to his location, he can't send a prepaid shipping label. Or he can b) refund you and tell you to keep the item Or c) he can fail to respond in which case you can ask eBay to step in. They will refund and tell you to keep it.
Since you will need to wait til that EDD before doing anything, may I suggest reading the MBG which explains the protection eBay offers if/when a transaction goes wrong. I might add: Always check the seller's FB record as well as his location before ordering.
