Arbitrage and amazon, form letter (need advice)
Because of the influx of amazon sellers practicing Arbitrage I was forced to come up with the following form letter, I would like to know if anyone sees a problem with this from both a legal and personal point of view.
Greetings: to whom it may concern
I would like to buy this item from you.
This letter however is needed because of the
infestation of amazon sellers here on ebay practicing
Arbitrage
(that is where they sell you something without having it on hand
and having it shipped directly from amazon which they purchased
AFTER you purchase it from them.) I hope you understand.
If you are an amazon seller I would appreciate it if you BAN me
from your store because I will complain and leave negative feedback!
If you are an ebay small business not affiliated with amazon
I will relish purchasing from you as that was what ebay was intended for.

If you are an ebay seller and this offends you I do apologize but it has become necessary.

Come to think about it, I have such items listed as I write this.
Nothing to do with Amazon, and not to be confused with drop-shipping.

Good luck with that. However, how are you going to tell the difference between a regular drop shipper and one using FBA? I guess you are willing to be placed on the Best Buddy Lists, of both types of sellers.
FYI, mentioning negative feedback in the letter, might be seen as and reported as a violation of eBay's feedback extortion policy, since FBA is allowed, if you leave a neg.

·2 years agoIf a seller can drop ship from Amazon and afford to pay Ebay fees, you are a lousy shopper.
There are products that I know I can buy on Ebay for less than Amazon prices.
There are many products that I and most other buyers know are overpriced on Ebay, and Ebay's major losses in sales are for products which are sold on Amazon, Walmart and Target for better prices than an Ebay seller can provide.
On those items where these products are offered on Ebay for less than the big retailers, they are usually from liquidation channels, and may lack the manufacturer's warranty.

Aquiline is a back end tracking service used to translate Amazon's tracking numbers and those from other shipping agencies into one ebay's/PitneyBowes tracking tool can recognize.
"On may 29 tracking was posted as Aquiline, which led me to a page with no info
with a ebay delivery date of june 10th.
On june 1st it showed up on my ebay page as delivered (no package to be found anywhere)
and the tracking info on ebay now said UPS delivered, luckily I got a screenshot of it saying aquiline
I questioned the seller about it and he provided a pic of an Aquiline tracking page saying delivered
So I opened a case with ebay and he responded by telling ebay it was delivered by UPS".
To me this sounds like you became the victim of a fake tracking number scam. Something is sent to an address in your zip code, probably an empty envelope, or small package, that gets a delivered scan, which ebay's automated system, looks for and sees, thus denying your item not received dispute. Because of your three week hospitalization you may have passed the time for filing an appeal. It would help if you posted the ebay item number, which could let us check a few things out, that might enable us to tell you how to at least get a refund.

OP2 years agoHere's the thing with the aguiline tracking page there was a picture of a package sitting on my porch where none was found.
when I am dealing with honest people that provide me with tracking up front I am there to personally take deliver but I wasn't expecting it for another 9 days, I suspect that the seller being in my town may have,
well it's easy to drive up set a box down take a picture then leave with the box. all I have is a suspicion
and nothing I can prove.so....
and I am very careful about reading a page fully but there was no indication of it being from amazon
as to the pic I posted this came in yesterday two days after ordering it. with an amazon receipt showing they purchased it after I purchased it from them.

You may want to compose a similarly-worded letter regarding Walmart … as that’s who has been sending me items I’ve ordered from eBay recently.
Legally, the letter is probably fine. Personally, it comes across as ‘controlling’ … which many sellers may find objectionable. [BTW, I’m a buyer only.]

While I once owned a Kindle, I did not like it, and sold it on ebay, after cancelling my Amazon account. I have never sold anything on or from Amazon!!
I do have an ebay selling account, but have only sold used, mostly vintage and antique items.

Items purchased from sellers who use FBA do come with a basic sales receipt. That is because the FBA service also handles the returns, and the order number on the receipt is needed to process a return. If a seller buys an item from Amazon after selling it on ebay, it will arrive with "A Gift For You" receipt. I'd post a scan of one below, but can't find the file, I will post it when I do.

Yes you do have a right to know where your money is going to, nobody disputes that.
The break down is:
The seller gets most of your money, and eBay and Amazon get a percentage of it.
However, when you buy from China the Chicom Govt. gets the lions share and the seller a small percentage. Want to talk about trickery?
Not being an Amazon customer or seller I was not aware of their use of algorithms to inflate prices. However, it seems they are not the only ones doing that these days. At least on ebay, if you check a seller's feedback profile page most of the sellers using FBA have non positive comments mentioning receiving items from Amazon, from those like you who do not want to deal with Amazon. Which gives you a chance of avoiding them.
As for transparency do you know where every every item and/or their materials and components come from, when you buy at a brick and mortar store?

On may 28 I purchased some resin for $70
On may 29 tracking was posted as Aquiline

But over the last 6 months I have been shopping here more than usual and have seen what a problem this has become on ebay. So this is my personal solution. and all I asked was if anyone saw a way I could run afoul of the rules by doing this(which all your efforts did not address )
And by the way I only have 1 account and you can look and see everything
How many accounts do you have? I can understand 1 personal and 1 business but more than that

This reply will probably be a waste of time, but you do not seem to want to accept the fact that sellers who use Amazon's FBA service for the items they sell on ebay and other sites are not engaging in an illegal act. Seller's who do not own an item in advance of listing it for sale, are breaking the law, and are probably engaged in other illegal activities like triangulation fraud.
Arbitridge is legal as long as the seller buys an item in advance so that they own it prior to listing it for sale online. They buy it cheaper from one place and sell it for more on another.
Sellers who use Amazon's Fulfilled by Amazon (FBA) , BUY a product, have it stored at an Amazon facility, that takes care of the pulling, packing, and shipping of the Seller's product. Which is legal.
You may have your reasons for disliking Amazon and that is fine. But many of the reasons people dislike Amazon are the same reasons many people do not buy from China based sellers, who do not own the products they sell. Treatment of workers, Theft of copyrights, Counterfeiting of goods, Carbon footprint excesses, Tax and other subsidies by a government that actually owns the factories, warehouses, shipping services... and deals with international governing bodies, giving them a price edge over the competition.
At least Amazon had the guts to kick an estimated 50,000 Chinese sellers off of the site, and works to ferret out the ones using 3rd and 4th party partnerships to obscure product origins and remove them.
You on the other hand, seem to buy from China based sellers quite often, which to me seems to be quite disingenuous, since you are buying from a place known for which ever of the reasons you have, for not wanting to deal with Amazon.

It is sellers on ebay that are actually buying the item from Amazon and having it sent to you. Hence NON Amazon sellers.
Ebay dropship sellers use Amazon as their warehouse and can do so according to ebay terms.

Ebays rules state under buying limits and restrictions:
Buying limits placed by sellers
Sellers can make their listings unavailable to a specific list of bidders. They can block buyers with low feedback scores or buyers they no longer wish to do business with.
So attention all amazon sellers I would be more than happy to have you
read this and BAN me from your store, I only want to do business with hard working
ebayers who have the product on hand when I purchase it.

and if they ban me my goal has been achieved.

·2 years agoWhy do you need proof you sent it? It's either going to achieve what you want or the seller is going to ignore it. And if they ignore it proof you sent this letter gives no more options of action you can take than you have without it.
As for everyone doing it that only works if everyone is as obsessed with this as you are. And I seriously doubt that's the case.

No I don't expect them to admit it, but just like in a court of law
refusing to answer the question can be regarded as an admission
of what they are doing, after all the few that have answered it was always
to emphasize that they don't do that.

one is a receipt for purchasing from amazon
the other is the promise of a gift for your purchase
which I assume goes to the seller.

Sellers are not going to come out and tell you they are dropshipping from Amazon and violating policies.
You can usually tell just from their listings.

OP2 years agoYou are right, but up to now they have regularly banned me (after the fact and a few from before the fact)
from purchasing from them.
And ebay can't fault me if I inform them up front and they ignore it.
It's all about the proof of wrongdoing 🙂
