Would this be considered “not as described” — 19-inch 4-post rack?

I’d appreciate some advice on an item I purchased on eBay.
I bought a rack that was described in the listing as a 4-post 19-inch rack system. It arrived while I was out of town, and it took me some time before I was able to assemble and test it.
After setting it up, I started to suspect that the rack might not actually conform to the standard 19-inch rack dimensions. To make sure it wasn’t an issue with the equipment I was trying to install, I ordered a standard 19-inch sliding rack/rail assembly to test it.
Unfortunately, the mounting holes on the sliding rails do not align with the holes on the rack. I also found that the mounting holes for my PSU do not line up properly.
Based on this, it appears that this rack is not compatible with standard 19-inch rack-mount equipment, even though it was described as a “4-post 19-inch rack system.” If I had known this, I would not have purchased it, since compatibility with standard 19-inch rack equipment was the reason I bought it.
For those familiar with eBay’s policies, would you consider this an item not as described situation? What would be the best way to approach this with the seller/eBay, especially since some time passed before I was able to assemble the rack and discover the issue?
