why a 5 day waiting period for a negative review?

so same question as the subject line... why a 5 day waiting period for a neutral or negative review? I just received and started a return for a item from target's overstock store, it was not listed as a returned item but it was and it was some other brand, old, smokey smelling and definitely used. so why can't I post something to warn others that it is a possibility they should be aware of.

@clanmcfadden . The waiting period is so you can work things out if the seller is Top Rated. Just follow through on the refund request. After you get the refund then leave the appropriate feedback.
