When I bought an item from ebay and found out it was a stolen device and seller won't accept return.
I got an ipad for parts and the seller indicated the ipad has MDM on it which for me is the best case since as long as I know the device is under the seller's MDM;
But when I received the ipad, it has a MDM on it but the MDM is not the related to the seller; so I was curiously call the MDM's contact and later find out the ipad was a stolen device. I contacted the seller to determine if I can get a return / refund but the seller refused to and told me that I should ask them first if the device is stolen or not in detail. (Isn't it if the seller knowingly the device is not belong to them and re-sell it in ebay is against ebay policy)?
I also contacted ebay and they escalated the case; but due to the holiday, I cannot get the owner's letter stated the ipad was stolen from their company. By the time 10-day grace period is done, the owner finally send me the letter but at the time, ebay had reached the 10-day appeal period and they close the case.
The owner of the ipad had requested me to return it to them and thinking since it was initially stolen, I checked their legal team and kindly return the item back to their company. Now my lost of a stolen item was a seller's gain and ebay won't even take action for it.

I have the impression that you did too much.
Normally you can request a return for an item that doesn't match the listing.
And if a seller doesn't cooperate, you can ask eBay to step in after 3 full business days.

OP2 years agoebay denied my requested and they did said to escalate the case; but end up the device was not able to return to the seller. So i kindly ask the owner if they still want it. All i need is a part on the ipad for the screen replacement but once i saw the device still have an owner, my instinct told me something was not right.
Sounded like a computerized answer below(?) and ebay written their policy on re-selling the stolen item is prohibited but now i bought it and want to return it; and ebay seemed to side with the seller and allowing the stolen item to be sold and also, ebay received the transaction fee which may help supporting re-selling the stolen devices....

I suggest to reach out to eBay on social media and ask why a return was not honored.
