I've contacted a seller regarding an item that has failed but was sold with a 12 month warranty The seller responded at first asking for my order number but now nothing for 10 days

Warranties are issued by manufacturers and authorized resellers for the manufacturer.

Unless the seller was an authorized retailer of the item, or you purchased a separate third party warranty with the item, manufacturers warranties are not enforceable on eBay.
