Uproar over Zelda Switch 2 pricing
Summary: imzadi2016 expressed concerns about ordering a Nintendo Switch 2 from a vendor on eBay, given eBay's potential actions against sellers charging above MSRP. comics-scifi-collectibles explained eBay's policies regarding presale items, noting that sellers must ship within 40 days. Since imzadi2016's order exceeds this timeframe, comics-scifi-collectibles suggested using a chargeback or filing a refund request if the item isn't shipped on time. imzadi2016 acknowledged the violation of eBay's policy and considered the advice given.
I am both a buyer and seller here on eBay, and on Tuesday I pre-ordered a unit of the Nintendo Switch 2-Zelda Breath of the Wild 40th Anniversary Edition after every other online vendor from Amazon to Target sold out their pre-orders earlier that day. My wife wants this for Christmas and the vendor I went to was the only one selling that particular version. Now I am reading that eBay is considering going after vendors who are selling the system for far more than the MSRP and I was wondering if the vendor I ordered from is one of those-he goes by "captain patriot." I still want the system but I am reluctant about cancelling the order despite the high resale price-I would be willing to get a refund of all but maybe $10-25 so the vendor can pay for the shipping and make a tiny profit.
Sincerely-Jeff Heise

Mentor1 month ago@imzadi2016 eBay usually doesn't go after "scalpers" unless the items are for public health or safety.
What eBay does do is take down listings if they do not follow the presale policy. Sellers must ship within 40 days of the date of sale and have a 40 day handling time.
A buyer can only file a not received refund request up to 30 days from the last estimated delivery date stated in their purchase history, NOT a date mentioned in the description.

OP1 month agoConsidering that the sale took place on 9/8 and it does not street until 10/29, that is 52 days from purchase date so I think they might miss that 40 day window.

Mentor1 month ago@imzadi2016 yes, the seller is violating eBay policy. Your only protection if the seller doesn't ship is a chargeback with your payment method. Once you file a chargeback eBay can no longer help you and the payment methods ruling is final.
If you don't want to take the risk then file a not received refund request case as soon as it's one day PAST the last estimated delivery date in your purchase history.
