Unresponsive seller, past 90 day old 'pre sale', no delivery

Is it in any way possible to get ebay to force an unresponsive seller to communicate with me? I clearly made the mistake of Buying a 'pre sale' item and now that it is beyond 90 days ebay 'help' is useless. I can't leave negative feedback nor apparently can I rely on any help from ebay, I have tried everything I can think of. This seller has apparently decided to completely ignore me. It feels like I have no recourse and have just lost my money. I have filed a claim with my credit card company but still waiting to see how that may turn out. ANY help or advice would be greatly appreciated.

I'm sorry that happened.
You did the right thing by filing with your credit card.
eBay only allows presales to be delivered 40 days after purchased, you should have immediately filed an Item Not Received case.

Thank you for your reply, I do appreciate it. In a way I guess I was hoping there would be some way to cause punitive repercussions on this seller including feedback that would be damaging to his ability to continue to sell on ebay
