Trouble getting replies from a seller and just want my refund as it's past the delivery date

Hello, I ordered a figure from a seller more than a month ago. And anytime I ask for updates they would give me the excuse that they were waiting for updates from their supplier. The last time I heard from them was July 20th and they haven't replied to my messages since and we are now past the deliver-by date.
I've asked the seller to cancel my order with no reply. I even offered to only accept half the refund just to get money back. But they are not replying. I just want this to be over with as the person has poor communication.

Was the listing for a Pre-Sale item? If it was and the last estimated delivery date shown in your order details has passed by more than 30 days, you have lost your ebay money back guarantee (MBG) protections.
When you do not receive an item by its last estimated delivery date you have 30 days from that date to file an item not received dispute. Never let a seller stall you past that time frame.
FYI. Pre-sale or release listings have a limit of a 40 day delivery time, if the delivery time frame was longer than that you should not have bought from that seller.

Once you file an Item Not Received (INR) dispute with ebay the seller will have 3 days to respond bu either providing tracking that shows a shipper has the item or by issuig s full refund. If they do neither or make excuses, on day 4 open the dispute and click on the Ask ebay to step in button. A refund will be issued from the seller's account. It can take a few days to show up in bank account, or up to 30 days to show on a credit card statement, but a few days after the refund being sent, you can call the number on the back of the card to see if s refund is being processed.
FYI. before buying a presale item, check it out on the Mfr's. site to see if there are delays in production or release.
