This seller is breaking the rules of Ebay

Question

There is a seller who has an item up for auction at $120. I bid that amount and right before the auction ended, I was overbid by $2.00. To my surprise the item was not sold, and it was relisted immediately. Last week another person bid $120 for the same item. I do not know what happened, but the bid was not taken and the item is RELISTED AGAIN at $120. How can a seller get away with this?
