Theft during delivery

I purchased this on 3/31 and it arrived in my hands in Japan on 4/16. I immediately opened it and found that the item inside had been stolen. I requested a refund from the seller.
The seller told me that I should be able to get a refund without having to return the empty box, but is it okay if I just wait like this?

No. You need to file a Request for Return. I know you have nothing to return, but select Arrived Damaged or whatever reason is close to that. Take a picture of where the packaging showed that it was tampered with and attach it to your claim. You have 30 days to do this. So waiting isn't a good idea.
