Sold an item and the buyer returned the case
The case was missing the disc which was brand new and sealed when the buyer received it, She wanted to return it and I said ok, she sent the empty case but no CD. Ebay sided with her and wouldn't listen to me. What is my recourse? if any

Your post is somewhat confusing. What I'm reading is you shipped a sealed CD in a case to your Buyer. Did the Buyer open an Item Not as Described refund request saying there was no disc inside? And then returned an empty case?
Did you not issue a refund on time and then eBay stepped in and forced the refund? Is there a reason you did not refund?
As far as recourse, I would block this Buyer. I would also report them to eBay. The feedback they leave for Sellers shows a pattern of doing this.
You could try to appeal the refund because of that. There's a deadline to appeal.
