Should I close my account if I've been scammed? Can I still get a refund or will I need to pursue in courts?

I ordered a phone on March 31st. I worked with the seller giving them time to contact the shipper. I contacted ebay when the item appeared stuck in shipping. Tracking showed the item was returned to seller. Ebay put the case on hold. I've haven't received any contact from ebay or the seller to explain why the phone was returned and I was not refunded. The seller has the phone. Ebay has the tx fees. I've had to order different, cheaper phone so I can have a phone. I appreciate help but I need to cut my losses and let go.
The community link was the only link I could use to reach out. I left feedback but have never been contacted by ebay. Maybe this is normal and I'm just gullible. That's okay but I want to disengage from the scam and move on. If I delete my account can I still seek action against ebay and the seller?

Do not delete your Ebay account.
You need your money back. The easiest way to do that is to file a dispute through Paypal (if you used Paypal) or to contact your funding source.
This was not a scam.

When you say eBay put the case on hold, what kind of a case are you talking about? Item not received? If so tracking never showed it was delivered to your address so you should be able to win that claim but that has to be done within 30 days of the estimated delivery date.
What does the tracking history show on that item in your Purchase history?
The Seller could obviously just ship it out to you again but I suspect they are not going to and are attempting to keep the money and the phone.
If you used a credit card you can try doing a charge back. If you paid with PayPal they allow claims up to 180 days from the date of purchase.

OP2 years agoSuper helpful to know. Thank you. I feel like ebay and the seller are pushing it past the 30 days because I've been easy to deal with.
The tracking results were truncated in my account but I found a link to the results in my browser cache. The phone came within a few miles of me and was intercepted.

OP2 years agoReceived some apologies from the seller. He's claiming ebay has my money Case had been on hold for ten days. I'm starting to feel upset. I'm willing to spend a couple grand on an attorney if it can help others avoid this situation in the future. Can anyone point me to legal contact information? Having the correct information for a filing will save me a grand. You can lmk brentfm/gee male

OP2 years agoLast update: ebay blamed the seller even though I provided them with valid tracking information from the start. What a ss ebay has become.
