Should I cancel the case?

I didn't get any tracking information and so I opened a case. The seller then replied and let me know they already sold the item on another platform and don't have it anymore so they would like to refund me. I can't cancel the order anymore so the seller now wants me to cancel the case so they can refund me. Is this true or will I no longer be protected with the ebay purchase protection. At this point I just want my money back.

You opened an item not received case on eBay correct? If so do not cancel, the seller does not need you to cancel to refund you. If you cancel you will not be able to re-open it or open another one when the seller does not refund.

eBay gives sellers 3 business days to refund, if it has been longer than that you can ask eBay to step in and refund you.
