Shipping label mix up
I messed up on a shipping label. Printed two and didn’t notice. Person received one of his packages and someone else’s. He will not return what isn’t his! I looked up a UPS 1 mile away from his house and he will not respond to any of my emails. I tried contacting eBay and that’s a lost cause😡 I don’t know what to do. He stole this from another person. Yes it was my fault. He swore at me in the email about getting it. Is there a way to charge him for the item? I know I’m going to have to refund the original buyer that didn’t get it. What do I do????

He did NOT steal it. You shipped it to them by mistake. The buyer is not required to return it.
No, you cannot charge him for the item you mistakenly shipped to him.
According to USPS: If you opened it and you like it, you may keep it. By law, you may keep unsolicited merchandise and are under no obligation to pay for it. If you opened it, and do not wish to keep it, you may simply dispose of it in the garbage, as long as it is safe to do so.
Refund the buyer that did not receive their item.

OP2 years agoThank you for your answer. It doesn’t make it right. I understand it’s my fault but the lack of others integrity is disheartening. I would never have done that if someone else made that mistake to me. Especially knowing someone else had purchased it and was expecting it. People are trash.

I completely understand and sympathize with your situation. Morally and ethically the recipient of the wrong item should have refused delivery so that it would automatically be returned to you.
Did you provide them with a prepaid Return Shipping label?
Unfortunately for you, since this was an unsolicited package, they are not legally required to return nor are they required to pay for it since they did not order it.

OP2 years agoI told them I would do a prepaid shipping for them even found the closest UPS which was 1.4 miles away from their house. That way they wouldn’t even have to repackage it up. Good thing this wasn’t in the $$$$.$$! It was $100 loss though. I’m not a store and this hurts bad.
