SHADY STUFF from ebay and apparent foreign seller!

If a seller sends this (message below), then refunds a penny, then marks the item as shipped even though they said they could not ship it, then ebay suspends their account.... What are my options? I have already paid for the item $306.72 (now $306.71 since I received a penny refund)..
Seller's message before they were kicked off ebay:
"Dear valued customer,Due to an ongoing system malfunction on eBay, our account is unable to process product shipments. There is currently a widespread technical issue with eBay’s platform.Please contact your credit card provider to file an Item Not Received chargeback. Once you submit this dispute, we can process your full refund without delay.Please do not apply for a refund through the eBay backend. Thank you."

Why would you listen to someone trying to get you to go around policy.
eBay protects the buyer. Go to your purchase history and select the item and under more actions select I never received it or if you did receive a penny, then its not as described.

OP3 weeks agoWould appear this EXACT scenario happens FREQUENTLY, why has ebay not done anything about it?
Also, I've already filed a INR claim... which takes time, and sometimes doesn't work out in the Buyer's favor. Know this 1st hand.
