Is it illegal to sell a product that hasn’t been put out yet for pre order or out to the public yet but is being sold now on eBay for pre order product doesn’t come out till October an pre orders don’t start till September

The seller must ship within 30 days of the purchase on eBay. S/he will have to specify a date s/he will ship within the 30 days and that plus the carrier's estimated transit time add up to the estimated delivery date you are given when you pay, and which controls when the 30 day period for filing an Item Not Received claim (and a Not As Described claim if the actual delivery is later) begins to run. Do not let any seller string you past that deadline. If s/he is saying in the description something that is later than the estimated delivery to your location shown in the Shipping, Returns & Payments tab of the listing on the full website, s/he is not to be trusted.
