sellers giving 1 year warranty but not honoring it because of ebay 90 day policy
Hi Ebay community.I bought a samsung refurbished phone from a company that sells 1000s of phones.I t was advertised as cming with a 1 years warranty.The reason i bought from this seller was because they offered a 1 year warranty and not 3 or 6 months that others offered.I paid £179.99 for it,more expensive that other sellers due to the longer "warranty" . Any way the phone was left in its box for 3 months as i was waiting for my brother to visit at christmas as hes good at setting up phones.So at christmas the phone was set up,after 2 weeks people i was talking too were complaining i sounded very un clear and quiet.The phone also became very hot,so hot i had to turn it off to cool down.I contacted the seller on the 15th and 16th of jan 2023 to explain the phones faults.The seller did not respond to me.Ebay only allow 90 days for you to claim a refund.The seller had advertised a 1 year warranty.They are still selling these refurbished phones and advertising them with a 1 year warranty.Where do i stand with ebay and consumer rights regarding advertising a warranty but not honoring it.Surely its false sdvertising.

·3 years agoSellers copy information off the box or the manufacturers website which may have a warranty written on the box on in product details but that assumes the seller is an authorized distributor.
eBay doesn't warranty anything and they can't force the seller to make good on a warranty but they do have a warranty policy that says if a warranty is offered the full written text of the warranty details such as how to obtain service if you need it has to be in the listing or a link to it. Did you register the warranty with the manufacturer when you first purchased it?

OP3 years agoThe bottom line is theres a seller advertising in the main title of the advert that the phone comes with a years warranty.People seem to think that doesnt matter.That they should be able to get away with this.I would not of paid £179 for this phone if i thought the warranty would not of been honored.There were plenty of other sellers offering only 3 months or 6 months warranty but the price was cheaper.It is FALSE advertising.

I am so sorry this happened … but eBay’s Money Back Guarantee (MBG) lasts only 30 days from the day we receive the item.
eBay says it is not responsible for what is said in listings because it has no way to know whether anything said is truthful. It offers a great MBG … but only if filed within 30 days of receiving the item.
Unless a seller is licensed by the manufacturer to sell the product … anything said in a listing about a warranty is meaningless. That goes for 3- and 6-month warranties … as well as 1-year.
You may still have time to request a refund from PayPal or your credit card company if the seller isn’t responsive.
I wish I could offer better news. Many buyers have had problems thinking they had a lengthy warranty when they really didn’t.

OP3 years agoOk thanks for your reply.I will check,but im sure it was a payment via ebay linked to my bank account.Surely a seller advertising an item with a 1 year warranty who then doesnt (up to now) honors it is false advertising and illegal.

Mentor3 years agoIf you purchased a third-party warranty, contact the warranty service directly.
eBay's money back guarantee, which is not a warranty, only applies in the first thirty days after receipt of the item.
Manufacturer's warranties typically only apply if you purchase the item from an authorized dealer; check with the manufacturer to see what your options are.
A warranty is only as good as the reputation of whoever offers it. A claim of a one year warranty made by a random seller on eBay is not worth much. Neither you nor eBay can force the seller to honor the warranty if the seller disappears or ignores you.
You may have some protection from PayPal or your payment method; PayPal and many credit cards may offer up to six months protection for your purchases.

OP3 years agoIf a random seller sells whats advertised as a rolex and it turns out not as advertised surely its false advertising,same as selling an item with a yrs warranty but not honoring it.I will contact ebay tomorrow.

Mentor3 years agoIf a seller is selling a Rolex, ebay has an Authenticity Guarantee. There is no such thing for refurbished phones, unless you purchase a third party warranty (such as those offered by Allstate).

A buyer on eBay has thirty days to file a "not as described" claim to get a refund. After that, eBay cannot help.
If a seller makes a false claim but the buyer waits until after eBay's money back guarantee expires before taking action, eBay cannot help.
Saying that the seller is engaging in false advertising may be true, but saying that does not actually help you if the seller disappears or just does not care about maintaining a reputation the way that an established company might.

OP3 years agoWhat do you mean by a random seller??? The company has a massive stocklist and has 10s of 1000s of sales and history.
