seller yet no proof of shipped item, refused cancellation; bought 10/11 today is 10/20. Want $ back!
I started cancellation 4 days after purchase, there wasn't any indication that item was shipped. Ebay responded on 10/19 they were unable to cancel. Still no indication of shipment. No tracking is posted. Unable to get ebay to talk to me. Unable to send any more messages to seller. Ebay says seller is not obligated to refund me. I want my money refunded. Can't start a "return"; item never shipped! If item
arrives this week and a tracking # is on package I will be able to prove seller refused cancellation when
item was still in seller's possession. If I refuse item for it to return unopened to seller, I still have no assur-
ance my $101 will be refunded (that is how much I paid total with shipping), or even $85 purchase price.
IF ITEM WAS NOT SHIPPED when I made request for cancellation is seller still able to insist I can not cancel?

Mentor10 months agoSellers are not required to cancel just because a buyer requests it, though a wise seller would do so if the item has not already shipped.
Sellers are not required to provide tracking until after an "item not received" case has been started -- which can be done the day after the last estimated delivery date. If the seller does not cooperate at that point, after three days the buyer can ask eBay to step in and force a refund.
Not all sellers ship with tracking. Of those that do, not all shipments receive acceptance scans or timely tracking updates. Your item may have been on its way already when you tried to cancel.
Do not refuse a delivery or you will forfeit your money back guarantee (except in cases where items arrive owing shipping).

OP10 months agoThank you for your answer. First, in all the years (15) I have been ordering on ebay, I've NEVER had a seller not post a tracking number! I understood from what I read the seller was to ship within 3 days of payment. And, while I made my request to the seller, the response was from ebay saying I had to give 4 days for response; therefore, I thought it would be that long for seller to reply and refund. Then, I got notification from ebay they were unable to cancel my purchase. So, what you are telling me is the date it says item is expected to arrive;(now says the 23rd) if I do not receive the item, then I can file a claim not received. So, supposing the seller had not shipped it; ships it out before that expected date, (23rd), say tomorrow, or WHENEVER (!), and shows proof it has been shipped, AND AFTER MY CANCELLATION REQUEST, I will be obligated to wait additional time for the arrival, and when the item arrives, in a nutshell, I am obligated to keep the item, even though it will not arrive by when the item was supposed to be here.

Mentor10 months agoYou should be able to file an "item not received" case the day after the last estimated delivery date shown at the time of your purchase. Once you have started the case, the seller will have three business days to provide tracking that shows delivery or else you will be able to ask eBay to step in and force a refund. Do not close the case until you either have the item or your refund. Be sure to ask eBay to step in within twenty-one business days or eBay may close the case without a refund.
Every seller is different; different sellers have different handling times. New sellers may not be familiar with how eBay works, and how funds may be held, and this can cause delays. If you have never encountered a seller that did not provide tracking, you have been exceedingly lucky in your eBay dealings.
If the item arrives well after the last estimated delivery date and you have not already been refunded for your "item not received" claim and you do not want the item, you can return the item as "not as described".
