Seller uploaded another listings photos, and claims he "can't" cancel the order and he won't ship.
Long story short, I purchased a used watch from a seller (let's call him seller A) and after my purchase, I realized that there was another seller (seller B) that had an almost identical listing with the same exact title and the same exact images.
So, I concluded there were only two possibilities. 1. Both accounts are the same person, or 2 one of the accounts is lying and does not own the watch in the photos.
I asked seller B if he was the owner of the account of seller A, and seller B said that he was not. So I'm left with option 2.
I can prove that seller B is the one who originally took the photos and the one with the actual watch, since one of the only differences is that the listing of seller B has 5 unique photos of the watch, while seller A only uploaded 3 of those 5 photos.
So I can only conclude seller A stole photos of the item from seller B.
When I confronted seller A about this, he dodged my question. I then told him to refund me, or I would contact eBay (The item still hasn't shipped after 3 days even though it's promised in 2). I already submitted a cancelation request which he denied with the reason being the item "already shipped".
The item still hasn't shipped, though it has received a tracking number, and the seller said he would not ship and also told me to open a case with eBay.
To complicate this further, I cannot open an "item not received" ticket since it wants me to wait until the date of expected delivery (a week from now), even though the seller told me he would not ship.
What should I do?
