Seller stated shirt is "XL", tag on shirt is XL. Shirt is 3XL Seller and does not take returns.
Seller stated shirt was an "XL". Tag on the shirt is an "XL". Seller does not accept returns. I purchased the shirt and the shirt is at least a "3XL" seller said I would have to pay shipping to get a refund. Is that correct? Thanks,

Yes, you will have to pay the return shipping if the item matches the pics and description. The Seller may have gotten a hold of some factory rejects somehow that were labeled incorrectly ... either knowingly or unknowingly.
