    Seller Stalling.
                     

    I won an Auction for an IPad 2 days ago...  I immediately paid for the Item via PayPal when notified I won.  Paypal and Ebay now show the item has been paid for from my access!

     

    BUT: The seller is telling me Ebay is not sending her the money, and she will not ship the order until the money is deposited into her account.  It will be 4 days tomorrow.

     

    Below is our conversation in reverse ::  is this a Normal Event?   Does Ebay sometimes stall paying the seller for 3 or 4, or more days?   Should I try to get a refund on this sale and try another seller? 

     

    This is a Christmas Present, so I don't have weeks to wait for resolutions.

    Update:

     

    Well... The Seller is still refusing to ship  the ipad...   Sticking to her contention that she isn't going to ship until AFTER Ebay deposits the payment into her checking account.   When a sale goes bad, it is a total PITA!  I am out $675 until Ebay will get around to refunding it after I make my case, which will probably take a week or two.  In the mean time, I can't buy another one, just on the off chance that she goes ahead and sends me this one, then I'm stuck with 2 of them.   And this is a Christmas Present, so timing could not be worse for such crap.

    @r_barbre.  Sorry this seller is clueless. 

     

    You can go ahead and buy another if you can afford to.  

     

    The sellers money is not going to be released until tracking shows delivery, and even then the funds can be held for up to 30 days 

     

    If a miracle occurs and they do ship you can file a return request stating that the item using the reason doesn't match pictures or description since seller terms of shipping time are part of the sale agreement.

    I thought about that....

     

    In the sale it says in a giant blue box,  "Seller doesn't accept returns."

    The shipping tracking doesn't predict the item arriving until after Dec 14, so I have to wait until after that date before Ebay will let me file an "Order Not Received" Refund.  So I guess I'm just out my money at least until then.  I found another unit to bid on this morning... I may go ahead with that one, then fight for a refund of the other later down the road.  Waiting for her to respond to my last message, where I "nicely" told her she needs to ship my item right away, as Ebay will show I paid for it.  She kept going on about trying to call Ebay - which we all know Ebay doesn't really do phone calls.

     

    Buying can be as much fun as selling sometimes!  Especially with more costly stuff!

    A seller can state No Returns, but that only applies to Buyers Remorse returns (changed mind, found cheaper elsewhere, etc).  For Item Not As Described, eBay policy overrules the seller’s no returns policy.  And, as @comics-scifi-collectibles @stated, this would be exactly that.

    In my earlier post I gave you a link to the Money Back Guarantee.  Once you have the opportunity to read through that protection for you, you will realize that a seller with a No Return policy has to meet or exceed the requirements in the MBG.  So while your seller says they don't take return, it does not mean they don't refund.  All sellers actually have the option to take the return on an item or simply refund.  Your seller will have those options too if you ever needed to file a claim because of an issue with the product.

     

    But for you right now, that really doesn't matter.  You need to file the INR [item not received" case as I suggested in my previous post.

     

    Yes the INR process will take a little bit, but be assured the MBG will protect you.

    You will not be out the $675.  You are protected as a buyer on Ebay for things like this.  There is an important policy as a buyer you should be aware of.  The Money Back Guarantee.  Please take a few minutes and read through it as it is very informative.

     

    Go and file an INR [item not received] claim as soon as you can.  That will protect your money and start the process with the seller to either prove shipping, get it shipped or get it refunded.

    @r_barbre   Sorry you are having a hard time completing your sale.  This sounds like a new seller that doesn't understand how selling and getting paid on eBay works.   As for canceling the sale it's not simple for the seller either, they will have to refund you from a credit card or their checking account and then wait for your funds to be released to them so they will break even again.

    SELLER>>   You need to ship within your stated handling time that you had on the listing.  Be sure to ship using tracking.  Your funds will be held by eBay in your Managed Payments account and the buyer can not just take that money back, think of it like an "Escrow" account.      If you do NOT ship within your stated handling time then you will get a strike on your account for late shipment.  

     

    New sellers are also subject to fund holds that can range from 14 to 30 days after the tracking shows delivery.

     As for canceling the sale it's not simple for you as the seller either,  you will have to refund  the buyer from a credit card or  your checking account and then wait for the buyer's funds to be released to you so you will break even again.  Processing or held funds can NOT be used for a refund, even for an order cancelation.

    Yea - - I am not at all excited at the thought of the seller waiting 14 days before she ships the unit to me.  She seems pretty head strong on making me wait.   I'll message her with your info, and see what she does.

    Your only options at this point as a buyer is to ask the seller to cancel as buyer requested, which the seller is not required to do OR wait until 1 day after the last estimated delivery date stated in your purchase history and file a not received refund request if they don't ship.   

     

    Sorry that this is happening.   It's always best to look at a seller's profile page and click where it says feedback as a seller.    See what it says and if they have been selling for awhile or not.

    Your seller is going to have much bigger problems as Ebay isn't going to let them get away with doing that for long.  It will affect the health of her selling account because they are shipping late.  And too many of those and they will get sanction.  

     

    I think your seller has a misunderstanding of the rules and it is going to cause them significant issues.

     

    It is likely in your best interest to request a cancellation and move onto a seller that is more familiar with the rules.
