Seller refuses to ship

Question

The seller refuses to ship the item I purchased. The listing stated that the item would be shipped in three days. Five days have passed. The seller claims that the war in Ukraine prevents him from shipping. The seller's messages to me make it clear that he cannot and will not ship the product. I asked him to cancel the transaction and refund my money. He refuses. The standard ebay dispute options do not permit me to register the item as not received until March 4. I do not want to wait until March 4, then start a dispute, then wait more time before getting my refund. How can I cancel the transaction and/or get a refund now?

Notably, the seller currently has over 400 active ebay listings even though he acknowledges that he cannot ship purchased items. This is a scam. What can I do?

@cmarc9 You cannot take action through Ebay until the latest estimated date of delivery has passed by at least 24 hours.
