seller refused to accept return for an altered winter coat
I am frustrated. I purchased a down winter coat from NCVapparel on December 17, 2023. It arrived on Dec 20, 2023. I did not try it on until a week later. It did not fit. The coat had been altered on both sides; someone had sewn a one inch seam on both sides! I wrote back to NCVapparel on January 19th:
Hello, I was very happy when I received this coat. Then, I tried it on. It did not fit and it should have. I am from New England and have purchased new and used LLBean clothing my entire adult life. Wondering why the size large was too small, my oldest adult child looked at the inside of the coat and saw that someone had used a sewing machine and sewed down both sides of the coat. I have attached some pictures. While I do sew and could remove the stitches so it would fit, the integrity of the down in the coat will be gone. It will no longer be an 850 Goose down parka. The coat needs to stay as is. It's now a medium, I believe. Another daughter is interested in the coat and it fits her as is. If you would be willing to split the cost and return $ to me, I would give the coat to this daughter. If not, I will return the coat to you. I will wait to hear back. Susan H. |
here is NCVapparel's reply:Hi again, after looking everything over the measurements at 22 inches is correct for this jacket. I currently have the same jacket in silver and its 22 as well. Not every style of jacket is going to have the same measurements with some brands varying 5 inches even. Looking at my other past listings I see that the ll bean jackets all seem to have a 21-22 inch chest armpit to armpit. All I can do is list the measurements in the description and hope my buyers compare and make thier best judgment. Im sorry but this has been delivered far too long for a return. Im not a big retailer or anything I just sell to make ends meet.Once again im sorry but I cant accept a return on this jacket due to the amount of time thats lapsed.'
I wrote back:Hello, I read your reply. I believe you don't understand that someone altered this coat and it is no longer the size you stated on the posting. Seams were sewn on both sides of the coat from the tip of each sleeve to the bottom. I have included additional pictures that clearly show the stitching done to make the coat smaller. I hope these additional, marked, pictures clearly show the alteration on this side. Same stitch line is on the other side. I will wait to hear back.

NCVApparel's reply: Hi again, I dont normally offer partial refunds but ill give you back $25 on it. After the cost of the item, fees and shipping id break dead even on it. I try to sell off my coats by mid January at the lastest because they stop selling after that. I had sent out good offers on all our coats the week before Christmas with hopes id sell more than we did. Spring is only a little over 50 days away now. Get back with me and ill get that out to you. I attempted to contact Vanessa to tell her that the $25 refund was not appropriate. I was unsuccessful. I also never received the $25 refund. I want resolution because this person sold an altered item and then ghosted me. I have spent a few hours going through Ebay's portal looking for a phone number for a human. The automated chat does not understand my statement "I was sold an item that did not match the listing" and various other phrases. I appreciate any and all help.

Mentor2 years agoYou received the coat on 12/20/23, and reached out to the seller on 1/19/24. You should have filed a Returns Request before that date, as ebay's Money Back Guarantee expires 30 days after receipt of the item. Too late for a return. You stated the coat fits your daughter, so I'd give it to her and be done with it.

Ebay protects your purchase for 30 days after the estimated or actual delivery date or within the seller's stated returns window, whichever is longer, through eBay's Money Back Guarantee.
The procedure starts with opening a return request for an item that doesn’t match the listing.
