Seller lying about their location
I bought from a seller claiming to be in Colorado, when they are drop shipping or shipping from China taking weeks to get here. Their other items for sale list various places around the United States, when they are shipping from China. This had to be against ebay rules for sellers.

Here's what to do if the item is not received by the estimated delivery date...
Check the estimated delivery date shown in your Purchase History. When that date has passed, you have up to 30 days to use the option next to the transaction to open a case for an item not received. The seller will have 3 business days to prove delivery or refund. If he doesn't, go back to the case on day 4 and use the option to ask eBay to step in. eBay will force the refund.
As mentioned, you can report the seller for item location misrepresentation, but the focus should be on getting your money back.
There are so many untrustworthy sellers from China, you need to be very careful about buying from one. Unless they have stellar feedback (at least 99.9% positive) and a strong selling history, I would pass. You can find the seller's country of registration on his feedback page.

Yes, eBay Policy clearly states that Sellers have to be accurate with the item location and where it will ship from. Use this link to report an issue with the Seller: Report an issue with a seller | eBay
You are protected by the eBay Money Back Guarantee for 30 days from the latest estimated delivery date: eBay Money Back Guarantee policy
You can file a claim via the item in your Purchase History that you did not receive your item one day past the original estimated delivery date and up to 30 days after that. Follow the steps in the claim and they will lead to an eventual refund.
