Seller lied to me about accepting returns
Summary: trage_3 is unhappy with a clothing purchase due to a misleading return assurance from the seller, who initially promised to accept returns but later refused. The item was inaccurately described and did not fit as expected. comics-scifi-collectibles advised that the eBay Money Back Guarantee does not cover buyer's remorse, explaining the difference between 'does not fit' and 'item not as described' claims. trage_3 expressed frustration, feeling misled both by the seller and eBay's policies. myangelandmyprincess clarified that eBay's 'does not fit' term applies when an item matches the description but doesn't fit the buyer.
Seller listed an article of clothing with "does not accept returns" but assured me personally that he always accepts returns to trick me into taking a risk to buy the item. The item is an xl but he measured an area that is much baggier than everywhere else as being 26 inches wide without explaining that the rest is only 23 inches wide making it fit more like a medium. The clothes simply don't fit and I'd like to return it. However now the seller is refusing to allow the return after assuring me he would. What can I do?

Mentor2 weeks ago@trage_3 I am sorry all you can do is leave appropriate feedback and resell the items.
When a sellers listing says no returns they can deny returns for remorse reason such as doesn't fit.
The eBay Money Back Guarantee overrules the sellers return policy when an item is not as described.
If you had filed the return case with a not as described reason such as doesn't match description ( because the measurements) then the seller would have been required by eBay to issue a return label and refund 100%. This may be what the seller meant when the said they accept returns.

OP2 weeks ago · EditedHow does "does not fit" differ from INAD is this not misleading and purposely confusing semantics on ebay's part? None of this is made clear up front. No other major physical store denies returns from dissatisfied customers who are taking massive risks with their money.

Mentor2 weeks ago@trage_3 eBay considers does not fit, changed mind, found a better price, etc buyers remorse return reasons. Buyers remorse returns are NOT covered by the eBay Money Back Guarantee. Remorse returns are only accepted if the sellers listing has Free Returns or Buyer Pays Returns.

OP2 weeks agoDoes not fit literally is an item item not as described by definition

Mentor2 weeks ago@trage_3 Sorry, I do not make the site rules. I can only advise you as to what they are.

OP2 weeks agoIts quite clear that ebay is using a semantics trap and being purposely mysterious about it. Lets see if my bank will be as sneaky with my money as all of you have been.

Mentor2 weeks agoDoes not fit is meant for items that are described as the right size and measurements but don't fit.

OP2 weeks ago · EditedSeller measured 26 inches across pit to pit with a cropped image not showing the full ruler and my own measurements with the whole ruler in view show that its really 24 inches pit to pit showing everything uncropped and in full view. The whole body of it is only 23 inches wide. It literally, not just semantically, does not match his images or description in a way that makes it literally, not just semantically, not fit.

OP2 weeks ago · EditedAlso this guy completely lied to me and claimed that he always accepts returns for any reason after I told him I was worried about his no returns policy. I feel utterly lied to and misled by everyone who was involved with this. Scammed is the right word.
