Seller fraud , item not shipped but provided tracking to near by address.
I’m seeking advice on how to handle the following issue. The seller failed to ship the item to me, instead providing me with an UPS tracking number for a nearby address. Naturally, I didn’t receive the item. I contacted UPS, and the tracking indicated that the delivery was to a store nearby. I submitted a non-received case, but eBay sided with the seller because the tracking showed delivery to my town’s ZIP code.In light of this situation, I’m seeking your guidance on how to proceed.

I understand your frustration. I share it, fully.
What is the eBay Item Number for the item you bought?
I see the delivery says 2 lbs, it was received by "Parts" and left at "Store"
Is 2 lbs a logical weight for your item?
Was your delivery city the same as in the tracking? (M-burg PA?)

I'm sorry that happened.
1) If your name and address weren't on that label, ask the UPS if they will put this in writing. Also, ask for the weight of the package using that tracking number. Follow the rest of the steps here:
2) Then, report the seller using this process

Important, select "The seller has violated one of eBay’s policies"
then "Other"
Explain that the seller is using fake USPS tracking numbers
Include these phrases
Don't write a novel, it's initially being read by a computer, that's why I want you to use those 3 specific phrases in the message.
3) Finally, contact Customer Service and inform them that the seller uploaded a "false tracking number" on your purchase. Request a refund.
Use the Customer Service that is on social media this way:

Just sent a private message to the page. Explain you have a fake or false tracking number situation.
Let me know how this goes, I've been burned a few times myself (including on Amazon), but I have been able to get a refund following this process.

I followed all the steps.
I also chatted with support over FB messenger, but i got nowhere. The ebay wants to see the label of the mis delivered item, but of course UPS will not provost any written confirmation to the receiver , especially when i am not an actual receiver on the label. The scammers found a good loophole and eBay is just enabling their operation.

1) Try hard to get a written statement of some sort.
UPS won't tell you where it was delivered, but they may confirm *your address and name weren't on that tracking label*. Also the SIZE and weight of the package.
Perhaps the nearby store would write a statement, or write the information on a tracking printout.
I know it is a pain to try to get something in writing, but it's very useful.
Ultimately, if eBay won't help, you can file a chargeback, *however* you want the written statement either way.

2) File a written police report with your police department. They won't investigate, but you want a copy of the report.
3) Consider filing an Internet Crime IC3.gov case https://www.ic3.gov/Home/ComplaintChoice
4) Appeal here and upload your documentation (items 1-3 above)

Should eBay rule against you, then you will use the documentation you gathered to file a credit card chargeback.

OP1 year agoThank you again for the insight. Very valuable information. But for the $200 item, no one has time to go to the police or to the nearby store and ask them to write a statement. That’s what the scammers are betting on.

Even it says deliver to the store the ebay representative did not care. I don’t understand why they don’t ask the seller to provide the proof of delivery.
Since I lost the case with eBay, I have to try something else. I submitted a ‘return’ for this order. I will see if eBay will honor the return. The ebay is making me to use the same tactic as the seller. How shame the eBay turned into the scam fest.
