Seller Doesn't Want to Cancel Counterfeit Item Before It's Even Shipped
Summary: needtoburn discovered that a recently purchased 1TB Micro SD card with Nintendo Switch branding was counterfeit, as Lenovo never produced such a model. After requesting a cancellation, the seller responded by claiming ignorance of the counterfeit nature and suggested using eBay's Money Back Guarantee to avoid a loss. comics-scifi-collectibles advised that the seller was mistaken about how refunds work and explained that the refund process would indeed cost the seller. They provided detailed instructions for needtoburn on how to file claims if the item does not arrive or is not as described, emphasizing that eBay's policies protect the buyer.
I purchased a used "Lenovo" 1TB Micro SD card with Nintendo Switch Branding. I looked up to see reviews and speed tests on the card and found that Lenovo never made a Switch-branded card (only SanDisk did) and that the "Animal Crossing Leaf Green" model maxed out at 512GB. So this card was never produced and is a fake counterfeit. I requested to cancel within minutes of buying and messaged the seller.
The seller responded with "Oh no, i was not aware this is a fake sd card. Thank you for bringing this to my attention. It is unfortunate you didn't do some research before making the purchase as i would now have to pay ebay out of pocket and will be losing money to refund this. I encourage you to use eBay's Money Back Guarantee so neither of us will be at a loss."
Like what? A person who operates like this shouldn't even be on the platform. If they send this fake card to me and I prove that it is indeed a fake (which I will), won't they lose money from the Money Back Guarantee? Why do they think it will cost them money to cancel?

Mentor2 weeks ago · Edited@needtoburn Sorry you had a bad seller. They are confused about the way cancelations work. The refund, even for order cancelations, come from the sellers back up payment method for selling costs. HOWEVER once the refund reaches your account your original payment is released to the seller and eBay refunds their selling fees.
If they don't co-operate with a refund request case eBay will force a refund and they will get a DEFECT and they will not get their sellers fees back.
I have news for this seller... the eBay Money Back Guarantee case will actually hurt their account AND the refund comes from the seller, NOT eBay.
You will get a refund it will just take a little time.
#1 IF the item is late arriving>
File a not received refund request when it is one day past the last estimated delivery date stated in your purchase history. https://www.ebay.com/help/buying/returns-refunds/get-help-item-hasnt-arrived?id=4042 Then Ask eBay Step in and help on the 4th business day if the seller has not refunded you.
#2 IF it does arrive and is not as described>
The eBay Money Back Guarantee over rules the sellers return policy. You have 30 days from the date of delivery to file a not as described return request for most categories. Trading cards, bullion, coins, paper money, and items that are sold as not working or for parts you only have 3 days from the date of delivery to file a refund request case.
Here's what you need to do:
You should open a Return Request. Reason> Doesn't Match photos and description
Select the return item button on this page:
https://www.ebay.com/help/buying/returns-refunds/return-item-refund?id=4041&st=
4 business days after filing the return request if the seller has not provided a return shipping label or a full refund then ask eBay to step in and help:
https://www.ebay.com/help/buying/returns-refunds/ask-ebay-to-step-in?id=4701
Let me know if you need to return an item to another country as there are additional steps required. The seller pays return shipping for an item that is not as described no matter where they are located.
