Seller Dispute - How To Resolve
Item listed as free shipping. Seller used two duplicate shipping labels which resulted in postage due. Item received but won't refund the $51.05 postage due which I paid. His attempt at postal fraud isn't my responsibility yet, despite repeated requests he keeps making excuses and hasn't refunded my money.

I’m afraid you have no way through eBay to collect the ‘postage due’ money you voluntarily paid the PO.
What you should have done is ask the PO to hold onto the package while to contact the seller for the postage due … telling the seller that they would have to pay their own PO that money if the package is returned to them.
Only after the seller sends you the postage due money should you collect the package.

OP10 months agoTwo similar answers with solutions I understand but not happy with. My comment about postal fraud stems from the fact that he paid postage on one item and used the same USPS label to ship the second item; not much different than steaming off a cancelled stamp and sticking it on another letter. The package was delivered by USPS with a postage due notice. Never had a chance to refuse it as I was out of town. I suppose I was hoping the seller had some integrity.

You can always return a delivered package to the post office IF it’s unopened. [You don’t have to be physically present when a package is delivered in order to ‘refuse delivery’.]
Most of my sellers who shipped me packages with ‘postage due’ were … or claimed to be … unaware of making any mistakes when calculating postage.
[BTW, two packages can be sent with the same tracking number if the first is labeled 1 of 2, and the second is labeled 2 of 2. The listed weight would need to be the total of the two packages.]

I wouldn't jump straight to that seller "attempt[ing] at postal fraud."
However: you kinda made his lack of sufficient postage into your responsibility when you paid $51.05 to the shipper (USPS or FedEx or UPS). If you had refused delivery specifically because of that (very large!) amount of postage due, eBay would not have punished you in any way. eBay would have refunded your purchase entirely, including any sales tax you might have paid.

That seller is not legally required to refund any money to you. Two reasons:
1. You did not pay $51.05 to the seller or to eBay; the seller was not unjustly enriched. (You paid the shipper.)
2. You voluntarily chose to pay $51.05 to the shipper in order to receive the Item, the package.
As a matter of customer service, some eBay sellers would reimburse you, even partially, but no eBay seller is legally required to do so. Morally and ethically, sure, but the USA has no Immorality Jails or Ethical Failure Detention Centers.
