-eBay has a process for you and covered by their MBG. You file a return using the reason does not match pictures or description. eBay issues you a prepaid return label regardless of the Seller's return policy. You ship the item back, Seller is charged for the return label from eBay. Seller has 2 days to refund you, failing that you go back to the eBay return claim and ask them to step in.
-If you do NOT file a return the Seller is under NO obligation to refund you, they can accuse you of damaging the item and could possibly file an insurance claim with the carrier. The last thing you want to do is destroy the item you received. Return it as mentioned above.
-You do NOT have to be in touch with the Seller when filing the return mentioned above.

I don’t think this is addressed in the return policy. I would tell the seller to send the refund, then you will destroy it and send the photo.
Open a return so you have the situation documented.
Go to your purchase history - select return this item. Under reasons select does not match the description, and follow the prompts.
The seller has 3 business days to send you a return label or a refund. If he doesn't, or says he can not send a label, go to your case and click 'ask us to step in'.
