Seller advertised item as "Brand New", but item received was used!
Hello eBay Community Forum,
I recently purchased an item from an eBay seller, who had advertised the item as being "Brand New", however, the item I received was used. Not only was it dirty, but there was no original packaging and the Warranty Card, Users Instructions and the HDMI cable that come in the original box, were not included. In subsequent communication, the seller said that it was a good price for a used item, but if I wished I could return the item. (presumably the seller would pay the shipping cost for the return). Clearly, the seller was in breach of eBay's guidelines and policy regarding posting items for sale, on the grounds of mis-stating the condition of the item. Rather than the hassle of having to post the item back to the seller for a refund, because of the seller's mislabeling of the item's condition, I suggested that the seller, rather than paying for the return postage, instead refund me the original postage cost and in return I agree to accept the item as used, and that should be the end of it.
Please advise as to how I should proceed in this matter.
Thanks in advance for any advice.
Kind regards,
crisby.

Ebay has a 30-day Money Back Guarantee. If you contacted the Seller and he is saying you need to return for a refund, that may be their return policy in this listing. If the Seller is not open to a partial refund, you can open an Item Not as Described case. That will give this Seller options to resolve this with you. Ebay cannot force the Seller to issue a partial refund.

Mentor2 years agoThe easiest way is to go to your Purchase history, locate the item. You have 30 days from date of receipt. Click on RETURN THIS ITEM because it is Not as Described. You will need to click on MORE to see that option. The seller will need to provide a prepaid shipping label for its return. You print out the label, affix it to the box, and have the counter clerk scan the label. When tracking shows DELIVERED back to the seller, the seller needs to refund you within 2 days. If no refund, go back to the case and click Ask ebay to step in, to force the refund.
Since you have already communicated with the seller about refunding the cost of postage and keeping the item, once you file the Returns Request, the seller can propose a partial refund. You accept, and then the refund is made and you keep the item.

eBay can’t force the seller to offer you a partial refund - they can only force him to accept the return. Has the seller responded to your suggestion? You can open a claim for up to 30 days after receipt, so you can give him some time to respond, and/or send the refund.
If you open a return request, the seller can offer the partial refund through the request where ou accept it and then he refunds through the request.
If you need to open a return, Go to your purchase history - select return this item. Under reasons select does not match the description, and follow the prompts.
The seller has 3 business days to send you a return label or a refund, or to offer a partial refund. If he doesn't, or says he can not send a label, go to your case and click 'ask us to step in'.
