Sales tax on food in New Mexico

Question

I live in New Mexico where there is no sales tax on food.

When I purchase food items (bee pollen), I am

charged sales tax and I don't think I should.

I cannot find a way to connect with ebay to resolve this.

The seller says he is not charging the tax, Ebay is.

When I search for bee pollen, it is mainly listed under health and beauty, not as a food item. eBay determines the tax based on the listing category, so it would have to be listed in food to not be taxed.

There are about 200 bee pollen items listed in food.
