Sales tax being collected in a no sales tax state
I live in New Hampshire where we do not collect sales tax; however, eBay is charging my buyers sales tax on their purchases. Is there a way to stop this?

OP3 years agoThank you. However, that is only true if I have at least $100,000 in sales in that state. I do not have a nexus in any state.

·3 years agoEBAY has a nexus in the state. They are the ones required to collect and remit the tax. (And even if neither you nor eBay collects it, the tax is still due and the buyer is supposed to pay but it's pretty much an honor system which is why the states fought in the courts to get the "jurisdiction" over large sellers and "marketplace facilitators" like eBay to require them to do so.)

Mentor3 years agoSales tax is based on destination, not origin. The tax will be charged and paid to the state where the item is delivered.
