eBay charges sales tax based on the laws of the state the item is shipped to and the category it is listed in not the item. If an item can be listed in multiple categories it is possible tax is charged.
If you purchase an item that is not taxed but was in a taxed category you would need to go to your states tax authority for how to get a refund.
