The state you live in passed a law that requires sales tax on the shipping. Since there's that law, by definition the act is legal. At least, until overturned by a Supreme Court decision but that ain't coming.

·2 years agoEBay doesn't charge sales tax they only collect it on behalf of your state.
Many states charge sales tax on the entire transaction shipping included.
