Sales tax…
Why the states require the payment of sales tax on used items just shows their level of pure greed.
as a Pennsylvania resident, clothing, new or used, is not subject to this greed known as sales tax, but somehow I am constantly subject to paying the sales tax.
Why is this???
eBay… grow a set and refuse this illegal collection of taxes. In fact, refuse all collection of state sales taxes. This is not your responsibility!!! Of course the states will tell you otherwise and illegally threaten you with disallowing commerce to be legally undertaken in certain states.
come on eBay, you know this as you have attorneys on staff and/or contracted that have told you this.
Grow a set and stand up to this TYRANNY.

·3 years agoEBay was ordered by the Supreme Court to collect sales tax. New or used makes no difference. Sometimes for PA residents clothing is not taxed but sportswear is.

OP3 years agoPennsylvania does not collect sales tax on clothing with the exception of Formal Wear and Sports Wear.
My problem is since eBay has mandated the collection of PA sales tax more than half of the everyday wear items I have purchased on eBay , I have also been charged PA sales tax.
I have contacted eBay in the past about this with not a single reply. My recent post was prompted by two recent and separate purchases through two separate sellers that again I have been charged PA sales tax for everyday wear items.
If this Tyrannical Tax cannot be collected ONLY in instances where it should be collected, let me rephrase that to say, collected ONLY in instances where the tyrannical Pennsylvania Government has deemed the collection of said sales tax has been deemed legal, then the sales tax should not be collected at all. No Pennsylvania resident should EVER be erroneously charged this tax.
If this Pennsylvania Sales Tax is going to continue to be ERRONEOUSLY collected there must also be a simple and efficient means to have these charges immediately identified, expunged and refunded.
This is no different than being wrongly accused of a crime by eBay for merely purchasing used everyday clothing items which should not be taxed in the first place, where then eBay further plays the role of judge who knowingly and willingly imposes punishment in the way of a fine, call it a sales tax if it makes you feel better, and then requiring said tax to be wrongly paid by the poor consumer who lives paycheck to paycheck who could actually use those few bucks to buy a gallon of milk, but of course that money will never be seen again because you paid the sales tax because you needed to replace that old worn out pair of pants with the hole.

Mentor3 years agoNo, ebay has mandated nothing, your state under the court ruling has mandated ebay to collect there tax.
A few things could be the problem:
Items listed in the wrong category that is taxable.
Your state has different rules for online sales versus local sales.
There is some other error occurring.
You need to contact your state revenue department. They will look into it and decide who is at fault. Only your state can contact ebay and correct the problem, as ebay can only follow their rules.

Mentor3 years agoMake sure the clothing items you are purchasing are listed in a CLOTHING category, and those items should not be taxed if shipping to PA.
