Sale of photos from the newspaper
I purchased a photograph of Father Joseph Wenderoth. Did you get Father Wenderoth's permission to sell his newspaper photograph? He is a Catholic Priest who lives in Baltimore County, Maryland. In 1969 he married my husband and myself. I am a retired attorney. I checked with the University of Baltimore Law Library. Unless the photograph has a copyright, it is not legal to sell his photograph about something that happened in 1971 without his permission.

·2 years agoOriginal photos belong to the photographer (or to the person who hired the photographer, in the case of a newspaper), not to the subject of the photo. The owner of the original photo can sell it to others. Refer to copyright laws of 1976 to see that copyright is inherent at creation, and registration is not required (but desirable). To determine the status prior to 1976 (in this case, 1971) you will need to research further; but in general, even back then, if the work was published (as in a newspaper) the copyright was automatically applied without registration.
While I am not an attorney, I do have volumes of copyrighted works, so I try to minimally keep up with it.
