As a user you can report listings for policy violations, but to determine if something is counterfeit typically requires an opportunity to examine the item up close and also having a certain amount of expertise in the subject, neither of which eBay has.
Buyers that receive counterfeit items can return them for a refund at the seller's expense, provided the buyer recognizes that the item is not genuine in time use eBay's money back guarantee.
Verified Rights Owners can formally request eBay remove listings that are infringing, and eBay will comply.
