I almost fake the seller said he would give me a full refund if I give him a positive review. I told him refund first then a positive review. Is that fair. I think it is.

If you change the feedback first, you'll never hear from the seller again. This is a common scam from many sellers located in China.

If you received an item that is not as described, you have up to 30 days to open a return using the option next to the transaction in your Purchase History. The seller will have 3 business days to provide a prepaid return shipping label (which he won't be able to do from China) or else refund. If he does neither, go back to the case on day 4 and use the option to ask eBay to step in. They will force the refund.
