refund an undelvered item. Ebay not helping

Question

I bough an ipghone. The seller had been scammed into changing the delivery address without consulting with me. A refund request was raised but the seller did not respond. Ebay have been asked to step-in multiple times but dont seem to be active. I asked the seller to issue the refund but guess what, he is making execuses not to. What should I do?

When it's past the estimated delivery date shown in your Purchase History, you have up to 30 days to use the option next to the transaction to open a case for an item not received. The seller will have 3 business days to prove delivery or refund. If he doesn't, go back to the case on day 4 and use the option to ask eBay to step in. They will force the refund.

Did you use the option to ask eBay to step in?

Once you do, you will probably lose the case because the item was delivered - just not to you. At that point, you'll have to appeal to let eBay know the seller did not ship to your address.
